1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of the Text Amendment to the City Council; and <br />WHEREAS, on January 17, 2006, the City Council of the City of Colton ("City <br />Council') conducted a duly noticed public hearing on the Text Amendment at which time all <br />persons wishing to testify in connection with the Text Amendment were heard and the Text <br />Amendment was fully examined; and <br />WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br />occurred. <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: <br />SECTION 1. Section 18.22.040 of the Colton Municipal Code is amended, in its <br />entirety, to read as follows: <br />18.22.040 Conditional uses. <br />A. Animal boarding and health care. <br />B. Automobile servicing and storage. <br />C. Large collection recycling facilities. <br />D. Outdoor retail sales. <br />E. Utility operations facilities. <br />F. Transient Habitation <br />G. Uses compatible with other uses permitted in the zone, but not specifically mentioned <br />or easily identified as belonging to a use type. <br />SECTION 2. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds that the Text Amendment is consistent with <br />the General Plan of the City of Colton because permitting Transient Habitation as a Conditional <br />Use in the C-2 (General Commercial) Zone provides for land uses compatible with surrounding <br />property and the Colton Municipal Code and allows for a more comprehensive planning review of <br />future Transient Habitation establishments within the City. <br />SECTION 3. Based on the entire record before the City Council and all written <br />and oral evidence presented, the City Council finds the Text Amendment is consistent with the <br />City of Colton General Plan ("General Plan"), and will systematically implement the goals and <br />objectives of the General Plan. Moreover, the City Council hereby makes the following specific <br />findings in accordance with the Colton Municipal Code and state law: <br />A. The Text Amendment is in conformity with the General Plan of the City <br />because Transient Habitation in the C-2 Zone is a use consistent with the General Commercial <br />land use designation. <br />B. Numerous Transient Habitation establishments are currently located within <br />the C-2 (General Commercial) Zone as legal non -conforming uses.
