2 <br />19 <br />Wc <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Section 18.31.050 Prospective application. <br />Section 18.31.010 Intent and purpose. <br />The purpose of this Chapter is to permit the conservation of Delhi Sands Flower Loving <br />Fly Habitat in a manner that is consistent with the City of Colton General Plan and in a manner <br />that identifies those areas of the City where conservation agreements and easements will <br />preclude development of land that is otherwise available for development in accordance with the <br />applicable General Plan and Zoning designations adopted by the City for that land. In addition, <br />adoption of this Chapter will assist the City to meet its obligations under the California Planning & <br />Zoning Laws (Government Code, Section 65300 et seq. to prepare, adopt and update a <br />comprehensive, long-term general plan for the physical development of the City containing all of <br />the mandatory elements required by law in a manner that apprises the City of changes to the <br />data and assumptions upon which the General Plan and Zoning Ordinance is based. Finally, <br />this Chapter is intended to provide persons who enter into agreements for the purchase of <br />conservation land and easements with assurance that such land is indeed suitable as Delhi - <br />Sands Flower Loving Fly Habitat. <br />Section 18.31.020 Definitions. <br />For purposes of this Chapter, the following phrases and terms shall be deemed to have the <br />meanings ascribed to them in this section. <br />"Delhi Sands Flower Loving Fly conservation land" means land that is suitable for habitat <br />for the Delhi Sands Flower Loving Fly. <br />"Delhi Sands Flower Loving Fly conservation use" means the use of property for open <br />space conservation purposes or for the purpose of mitigating Delhi Sands Flower Loving Fly <br />habitat impacts where maintenance of the open space or habitat use is guaranteed or reserved <br />for a period of more than one (1) year by written agreement, contract, easement, lease, license <br />or covenant by an owner, lessee, licensee or other person that obtains such a property interest <br />in the land that precludes it's use for anything other than open space use or mitigation for the <br />Delhi Sands Flower Loving Fly. <br />"Overlay District Boundaries" shall be those areas of the City depicted on the attached <br />Exhibit "A." <br />Section 18.31.030 Map designation. <br />The Overlay District Boundaries shall be in the form of an overlay district over existing <br />zoning and specific plan land use designations and the boundaries of such district shall conform <br />to the Overlay Zone Boundaries shown on the attached Exhibit "A." <br />Section 18.31.040 Conditional use permit requirements. <br />A. Use of Delhi Sands Flower Loving Fly conservation land for Delhi Sands Flower <br />Loving Fly conservation uses shall require the submittal and approval of a conditional use permit <br />prior to the execution of any written agreement, contract, easement, lease, license or covenant <br />by an owner, lessee, licensee or other person that obtains a property interest in the land that <br />precludes it's use for anything other than open space or mitigation for the Delhi Sands Flower <br />Loving Fly. <br />ORANGE\MMARTINEZ\23217.1 -4- <br />
