This Urgency Ordinance was adopted by the necessary four-fifths vote of the members of the City Council pursuant to California Government Code Sections 36934 and 36937, and shall take effect immediately upon its adoption for the preservation of the public health, safety and welfare. The provisions of this Ordinance are hereby expressly made severable If any rule, section, sentence, clause, or phrase of these Ordinance rules, regulations, or its application to any person or circumstance or property is held to be unconstitutional or invalid, the remaining portions of these Ordinance, rules and regulations or the application of these rules and regulations to other persons or circumstances or property shall not be affected. The City of Colton hereby declares that it would have adopted these rules and regulations and each and every rule, section, sentence, clause or phrase thereof, irrespective of the fact that any one or more other rules, sections, sentences, clauses, or phrases be declared unconstitutional or invalid. SECTION 7. The Adoption of The Open Space Overlay Conservation District is exempt from further environmental review under Section 15061(b)(3), 15308 and 15317 of the California Environmental Quality Act (CEQA) as with the adoption of this ordinance there is no possibility of significant effects upon the environment. SECTION 8. City staff is hereby directed to prepare and file a Notice of Exemption, under the CEQA, within 5 working days of adoption of this Ordinance. SECTION 9: The City Clerk shall certify to the passage of this Ordinance and cause the same or a summary thereof to be published within fifteen (15) days after adoption in a newspaper of general circulation, printed and published in Colton, California.
