All conditional use permits shall be filed and processed in accordance with <br />Section 18.58.060. <br />Section 18.31.050 Prospective application. <br />The requirements of this chapter shall prospective beginning on the date of adoption. <br />Nothing contained herein shall be deemed to waive compliance with other local, state and/or <br />federal laws, statutes, regulations, codes, ordinances, or policies." <br />SECTION 5. Effective Date. This Urgency Ordinance was adopted by the <br />necessary four-fifths vote of the members of the City Council pursuant to California Government <br />Code Sections 36934 and 36937, and shall take effect immediately upon its adoption for the <br />preservation of the public health, safety and welfare. <br />SECTION 6. The provisions of this Ordinance are hereby expressly made <br />severable If any rule, section, sentence, clause, or phrase of these Ordinance rules, regulations, or <br />its application to any person or circumstance or property is held to be unconstitutional or invalid, the <br />remaining portions of these Ordinance, rules and regulations or the application of these rules and <br />regulations to other persons or circumstances or property shall not be affected. The City of Colton <br />hereby declares that it would have adopted these rules and regulations and each and every rule, <br />section, sentence, clause or phrase thereof, irrespective of the fact that any one or more other rules, <br />sections, sentences, clauses, or phrases be declared unconstitutional or invalid. <br />SECTION 7. The Adoption of The Open Space Overlay Conservation District is <br />exempt from further environmental review under Section 15061(b)(3), 15308 and 15317 of the <br />California Environmental Quality Act (CEQA) as with the adoption of this ordinance there is no <br />possibility of significant effects upon the environment. <br />SECTION 8. City staff is hereby directed to prepare and file a Notice of <br />Exemption, under the CEQA, within 5 working days of adoption of this Ordinance. <br />SECTION 9: The City Clerk shall certify to the passage of this Ordinance and <br />cause the same or a summary thereof to be published within fifteen (15) days after adoption in a <br />newspaper of general circulation, printed and published in Colton, California. <br />PASSED, APPROVED, AND ADOPTED, this 17 th day of January, 2006. <br />ATT T: <br />CAROLINA P.
