1!�SECTION 10. APPROPRIATE UNIT <br />2 (A.) The Municipal Employee Relations Officer, after reviewing!, <br />3 <br />Jthe petition filed by an employee organization seeking formal <br />lilrecognition as majority representative, shall determine whether <br />proposed unit is an appropriate unit. The principal criterion <br />I in making this determination is whether there is a community of <br />11interest.among such employees. The following factors, among others,' <br />Jare to be considered in making such determination: <br />(1) Which unit will assure employees the fullest freedoml <br />10 <br />11 <br />13 <br />14 <br />1-5 1 <br />in the exercise of rights set forth under this <br />Resolution. <br />(2) The history of employee relations: (i) in the unit; <br />(ii) among other employees of the City; and (iii) in <br />similar public employment. <br />(3) The effect of the unit on the efficient operation of <br />16 <br />the City and sound employer-employee relations. <br />1711! (4) The extent to which employees have common skills, <br />18 <br />working conditions, job duties or similar education - <br />19 al requirements. <br />20 <br />(5) The effect on the existing classification structure <br />r <br />21 <br />of dividing a single classification among two or <br />22 <br />more units. <br />23��Provided, however, no unit shall be established solely on the basis <br />24�lof the extent to which employees in the proposed unit have organized. <br />25 Ili (B.) In the establishment of appropriate units, (1) profession- <br />26,al employees shall not be denied the right to be represented <br />27 !separately from non-professional employees; and (2) management and <br />281�'�confidential employees who are included in the same unit with non - <br />29 �'Mnagement or non -confidential employees may not represent such <br />30 1 Omployees on matters within the scope of representation. <br />.I�ECTION 11.
