I - <br />1111 East Mill Street, Building 1, 2nd Floor <br />San Bernardino, CA 92415 (714),383-2611 <br />LAFC 1769 <br />Date: February 8, 1978 <br />RESOLUTION NO. 1372 <br />A RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO <br />MAKING DETERMINATION ON LAFC 1769 and approving the City ofColtonAnnexation {A <br />nderegg <br />On motion of Commissioner Hammock, duly seconded by Commissioner Jimenez, and <br />carried, the Local Agency Formation Commission adopts the following resolution: <br />WHEREAS, an application -for the proposed annexation in the County of San Bernardino ino <br />was heretofore filed with the Executive Officer of this Local Agency Formation Commission, <br />in accordance with the Municipal Organization Act of 1977 (Gov. Code Section 3500 et. seq) <br />and said Executive Officer has examined said application and attached plan for Services, <br />and executed his certificate in accordance with law, determining and certifying that <br />said filings were sufficient; and <br />WHEREAS, at the times and in the form and manner provided-by.law, said Executive Office <br />has given notice of public hearing by the Commission upon said application; and <br />WHEREAS, said Executive Officer has reviewed -available information and prepared <br />a report, including his recomthpiidations thereon, said filings and report and ralated <br />information having been. presentedto and -considered by this Commission; and <br />WHEREAS, the public hearing by this.Commission was.held upon the date and at the <br />time and place specified in said notice of public hearing and in any order or orders <br />continuing such hearing; and <br />WHEREAS, at such hearing, this Commission heard and received all oral and written <br />protests, all plans,and proposed changes of organization and reorganization,.objections <br />and evidence which were made, presented, or filed, received evidence as to whether the <br />territory is inhabited or uninhabited, improved or unimproved, and all persons present <br />were given an opportunity to hear and be heard in respect to any matter relating to <br />said application, in evidence presented at the hearing; <br />NOW, THEREFORE, BE IT RESOLVED, That the Local Agency Formation Commission . of the <br />County of 'San Bernardino does hereby find, determine, resolve and order as follows: <br />FINDINGS: <br />1. The territory proposed for annexation is legally uninhabited <br />2. Notite. as required by law has been given with no protests received. <br />3. All persons requesting to be heard have been given the opportunity to be heard. <br />4. The area can benefit from City services <br />5. 100% of the property owners have given their cionsentfor this annexation. <br />6. The subject property is contiguous to the City of Colton, but is outside its <br />sphere of influence. <br />7. The General Plan has been -reviewed -City and County zoning are compatible. <br />8. The area overlaps CSA 38, and CSA 38, Improvement Zone G-, CSA 70, and Improvement <br />Zone A, which should be detached upon annexation. Other special districts serve <br />the area. A complete list is in the file. None others. will, ' ' be affected.._::.- <br />9. The City of Colton has filed with the Commission a plan for service for -I*h-, <br />area as required by law. the <br />10. The matter was subjected to environmental review and a Negative Declaration issued <br />indicating the annexation will not have a significant effect on the environment. <br />The LAFC adopted the Negative Declaration, a copy of which is on file in the Office <br />of the Clerk, and directed the Clerk to file a Notice of Determination. No <br />EIR has been prepared in accordance with the California Environmental Quality <br />Act. (CEQA) <br />Maps and legal desriptions for the proposal meet State standards. <br />12. The boundaries are approved as set forth in Exhibit A attached hecto. <br />r <br />
