COUNTY OF SAN UERNA1101NU i 7111 East Mill Street, Building 1, 2nd Floor San Semaraino, CA 92415 • (714) 383.2611 LAFC 1779 Dater March 8, 1978 RESOLUTION NO, 1381 A RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO MAILING DETERMINATION ON LAFC 1777 and approving the Reorganization to include annexation to the City of Corton X14 and detachment from the City of San Bernardino On motion of Commissioner Hammock, duly seconded by Commissioner Bertolotti, and carried, the Local Agency Formation Commission adopts the following resolution: WHEREAS, an application for the proposed reorganization `im the County of San. Bernardino was heretofore filed with the Executive Officer of this Local Agency Formation Commission, in accordance with the Municipal Organization Act of 1977 (Gov; Code Section 3500 et: seq) and said Executive Officer has examined said application and attached plan for Services, and executed his certificate in accordance with law, determining and certifying that 'said filings were sufficient; and WHEREAS, at the times and in the form and manner provided'by-law, said Executive Office has given notice of public hearing by the. Commission upon said application; and WHEREAS, said Executive Officer has reviewed available information and prepared a report, including his recortnhandetions thereon, said filings and report and ralated inforration having been presented to and considered by this Commission; and WHEREAS, the public hearing by this Commission was held upon the date and at the time and place specified in said notice of public hearing and in any order or orders continuing such hearing; and WHEREAS, at such hearing, this Commission heard and received ail oral and written protests, all plans and proposed changes of organization and reorganization, objections and.evidence which were made, presented, or tiled, received evidence as to whether the territory is inhabited or uninhabited, improved or unimproved, and all persons present were given an opportunity to hear and be heard in respect to any matter relating to said application, in evidence presented at the hearing; NOW, THEREFORE, BE IT RESOLVED, That the Local Agency Formation Commission of the County of -San Bernardino does hereby find, determine, resolve and order as follows: FINDINGS: I. The area includes 7.7 acres, has no registered voters and is legally uninhabited..' 2. The proposal has consent of 100 of the property owners. 8. Notice as required by law has been given, with no protests being received. 4. All persons requesting to be heard have been given the opportunity to be heard. 5. The applicant has submitted this application pursuant to the provisions of the Municipal Organization Act (MORGA) and the City of Colton has filed a plan for services which indicates that the City can provide the full.range of City Services immediately upon development. 6. The area is zoned residential, and will benefit from the annexation. This land use conforms to the General Plan. 7. The matter matter was subjected to environmental review and a Negative Declaration issued indicating the annexation will not have a significant impact on the .environment. The LAFC adopted the Negative Declaration, "a copy of which is on file in the office of the Clerk, and directed the CIerk to file the Notice of Determination. No EIR has been prepared in accordance with the California Environmental Quality Act (CEQA). 8. The map and legal description meet state standards. 9. Some regional districts serve the area, they will not be affected. l0. The boundaries are hereby approved as set forth in Exhibit A attached hereto. 11. Notice of the'Reoraanization has been mailed to the cities of Colton and San Bernardino, and no protests have been recieved.
