C. :'UUNTY OF SA'1 131-11NARI)INU <br />!- -- 1111 Fast Mill $trent• nuiltting 1, 7.nd F1nor <br />San Bernardino, CA 92415 1114! 383.2611 <br />LAFC 1774 <br />Dated: March 8, 1978 <br />RESOLUTION NO. 1375 % <br />A RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO <br />t4AKING DETERMINATION ON LAFC 1774 and A22rovinq the City of Colton Annexation South 32 - <br />(btest Propere erty) <br />On motion of Commissioner Forrest, duly seconded by Commissioner Gilliam, and <br />carried,the Local Agency Formation Commission adopts the following resolution: <br />WHEREAS, an `application for the `proposed annexation in the County of San Bernardino <br />was heretofore filed vjith the Executive Officer of this Local A enc <br />.y Formation fonunission, <br />in accordance with the Municipal Organization Act of 1977 (GavCode Section 3500 et. seq) <br />and said Executive Officer has examined said application and attached plan for Services, <br />and executed his certificate in accordance with law, determining) and certifying that <br />said filings were sufficient; and <br />WHEREAS, at the times and in the forst and manner provide by law„ said Executive Offic• <br />has given notice of public hearing by the Calnnission upon said application; and <br />WHEREAS, said Executive Officer has reviet•:ed available information and prepared <br />a report, including his,recommoodetions thereon, ;did filings and report and ralaced <br />information having been presented to and considered by this Commission; and <br />WHEREAS, the public hearing by this Commission was held upon the date and at the <br />time and place specified in said notice of public hearing a;;d in any order or orders <br />continuing such hearing; and <br />:WHEREAS, at such hearing, this, Commission heard and received all oral and i-n•itterl <br />protests, all plans and proposed changes of organization and reorganization, objections <br />and evidence t•:ilirh .ere made, presented, nr filed, received evidence as to whether the <br />territory is inhabited or uninhabited, ir:provcd or unimproved, and all persons prr'�ent' <br />t:ere given an oppol-tur,,ity to hear and be heard in respect to any ;natter relating to <br />said application, in evidence presented at the hearing; <br />NOW, THEREFORE, EE IT RESOLVED, That the Local Agency Formation Congnission of the <br />County of San Bernardino does hereby find, determine, resolve and order as follol•rs <br />F I ND I;•lG5 <br />1. The subject area is legally uninhabited. <br />2. Notice as required by law has been given. <br />3. All persons requesting to be heard have been given the opportunity to be heard. <br />4. The area can benefit from City services. <br />5 The subject property is contiguous to the City of Colton; but is outside its <br />sphere of influence. <br />6. The General Plan has been reviewed-City and County zoning are compatible. <br />7. The area overlaps CSA 38, and CSA 38, Improvement Zone G; CSA 70, and Improvement <br />Zone A, which should be detached upon annexation. Other special districts serve <br />the area. A complete list is in the file, none others will be affected. <br />8. The City of Colton has filed with the Commission a plan for service for the area <br />as required by lair. <br />9. The matter was subjected to environmental review and a Negative Declaration <br />issued indicating the annexation will not have a significant effect on the <br />environment. The LAFC adopted the Negative Declaration, a copy of which is on <br />file in the office of the Clerk, and directed the Clerk to file the Notice of <br />Determination. No EIR has been prepared in accordance with the California <br />Environmental Quality Acta (CE1A) <br />10, heaps and legal, descriptions for the proposal sleet state standards. <br />11. 'The boundaries are approved as set forth in Exhibit A`attached hereto. <br />
