-2 - <br />concerned Department Head, but must be exercised before a formal grievance may <br />be filed. The proposed decision of the Department Head shall be in writing and <br />personally served upon or mailed to the employee's current address. If the <br />employee is not in agreement with the proposed decision reached by discussion, <br />he shall then have the right to file a formal grievance, in writing, within <br />ten (10) days after the mailing of or personal serving of the proposed decision <br />of his Department Head. <br />IV. Matters Subject to Grievance Procedure <br />The City Personnel Officer or his designated representative shall make a deter- <br />mination whether or not an alleged grievance actually falls within the category <br />as established in the definition of a grievance in Section II of this procedure. <br />This determination is subject to the grievance procedure. <br />V. Formal Grievance Procedure (Levels of Review Through Chain of Commands - see <br />attached form) <br />A formal grievance shall be presented, in writing, to the employee's Department <br />Head within ten (10) days after having attempted to resolve the grievance through <br />the departmental discussion procedure. The Department Head (or in his absence <br />his designated representative) receiving the grievance shall provide an oppor- <br />tunity to discuss the grievance with the employee, his representative (if any), <br />and with other appropriate persons. The Department Head shall render this <br />decision or recommendation and comments in writing, and return them to the <br />employee within ten (10) days after receiving the appeal. If the employee does <br />not agree with the decision reached, he may appeal, in writing, to the City <br />Personnel Officer. Failure of the employee to take further action within ten (10) <br />days after receipt of the decision will constitute withdrawal of the grievance. <br />1. City Manager Review - The City Personnel Officer (or in his absence, his <br />designated representative) receiving the grievance shall provide an oppor- <br />tunity to discuss it with the employee, his representative (if any) or with <br />other appropriate persons. The City Manager may designate a factfinding <br />committee to advise him concerning the appeal. The City Manager shall <br />render a decision, in writing, to the employee within ten (10) days after <br />receiving the grievance. <br />If the employee does not agree with the decision reached, he may have the <br />option of by-passing steps 2 and 3 and appeal such decision, in writing, <br />to the City Council. Failure of the employee to take further action within <br />ten (10) days after receipt of the decision will constitute a withdrawal of <br />the grievance. <br />2. If, as a result of the City Manager, the grievance is not resolved within <br />ten (10) working days of receipt of said decision, the employee or their <br />representative may request, in writing, that the grievance be submitted to <br />the State Conciliation/Mediation Service for the purpose of mediating the <br />dispute in an attempt to reach resolution. <br />3. If, as a result of the State Conciliation/Mediation role, the grievance is <br />not resolved in Step II within five (5) working days after completion of <br />Step III, the employee or their representative may request, in writing, <br />that the grievance be referred to a Grievance Committee, made up of a <br />
