-3 - <br />representative appointed by the City, a representative appointed by the <br />Association and a third party mutually selected by the parties. The third <br />party shall be selected from a list of not more than six (6) names mutually <br />agreed to by the Parties. A list of six (6) names shall be agreed to by <br />the parties for each action pursuant to this procedure. Each party shall <br />alternately strike one name from the list until only one name remains. <br />The first party to strike a name shall be determined by lot. Fees and <br />expenses incurred as a result of requesting an impartial third party to <br />resolve an issue shall be shared equally by the parties. The Grievance <br />Committee shall, within 30 days from receipt of the appeal, hold a hearing <br />to receive testimony and submit its findings and recommendations to the <br />City Council. <br />4. City Council Review - Upon receiving the appeal, the City Council may adopt <br />the findings or shall schedule a hearing with the employee at a regular <br />adjourned or special meeting of the City Council. Following the conclusion <br />of the hearing, and not later than the second regularly scheduled meeting <br />thereafter, the City Council shall render its decision. The City Council's <br />decision shall be final, administrative remedy by which to resolve the <br />grievance. <br />VI. Conduct of Grievance Procedure <br />1. The time limits specified above may be extended to a definite date by mutual <br />agreement of the employee and the reviewed concerned. <br />2. The employee or the reviewer may request the assistance of another person, <br />i.e. a representative of his own choosing, at any level of review. The City <br />must be so notified if such is the case. <br />3. The employee and his representative may be privileged to use a reasonable <br />amount of work time, as determined by the appropriate Department Head, in <br />preparing and conferring about the appeal. <br />4. The employee shall have the right to be represented at all discussions out- <br />lined in this procedure. <br />5. The employee shall be given at least five (5) days notice of any meeting <br />requiring his appearance, throughout the grievance procedure. This provi- <br />sion may be waived by mutual agreement. <br />6. All communications, notices and papers required to be in writing shall be <br />served personally or by United States mail. <br />7. Any grievance should be treated as confidential information by all parties <br />concerned until after the final decision has been rendered. <br />8. Employees shall be assured freedom from reprisal for using the grievance <br />procedure. <br />9. To process a grievance through the levels of review, the employee must notify <br />his last reviewer, in writing, that he is not satisifed with his decision <br />and that he is carrying the grievance to the next level of review. <br />
