ELLIOTT AS <br />A LOCAL POLICEMAN ENGAGED IN ACTIVE LAW <br />ENFORCEMENT SERVICE, ASSIGNING DUTIES TO HIM <br />AND MAKING RELATED FINDINGS <br />WHEREAS, PHILLIP D. ELLIOTT ("Elliott") has been employed by the <br />City of Colton ("the City") continuously since August 21, 1958, and was <br />employed as a patrolman in the Police Department and, at all times, has been <br />qualified as a patrolman in the Police Department, and, in the course of <br />his employment by the City, has held positions in the Police Department as <br />follows: <br />Reserve <br />Patrolman <br />Detective <br />Sergeant <br />Lieutenant <br />Acting Police Chief <br />Police Chief, and <br />WHEREAS, Elliott has fulfilled the requirements -as set forth by <br />the Commission on Peace Officer Standards and Training by completing the <br />Basic Certificate, and has qualified over and above these requirements by <br />completing both the Intermediate and Advanced Certificates, and <br />WHEREAS, Elliott is a member of Public Employees Retirement System <br />(PERS) and has been a local safety member of PERS at all times while employed <br />by the City, and Elliott has declared that it is his wish that his status as <br />such a safety member be continued, and <br />WHEREAS, Government Code Sections 2001.9.4 and 20020 provide that <br />persons employed and qualifying as patrolman or equal or higher rank irrespec- <br />tive of the duties to which they are assigned may be a "local safety officer" <br />or "local policeman", and <br />WHEREAS, on occasions in the past, the City Council of the City <br />of Colton ("the Council") has from time to time assigned to Elliott other <br />
