May 14, 1982, with the intention that Elliott continue as Police Chief and that his status be that as of a local policeman whose functions are within the scope of active law enforcement service and to whom additional duties are assigned, and WHEREAS, PERS, by letter of July 25, 1984, notified the City that it questioned the status of Elliott as a local policeman and as a local safety member. NOW, THEREFORE, the City Council of the City of Colton resolves as follows: 1. The foregoing recitals and all of them are true and correct. 2. At all times since August 21, 1958, Elliott is and has been a "local policeman", an officer of the Police Department of the City whose functions at all times have been within the scope of active law enforcement service; that Elliott was employed as a patrolman and at all times has quali- fied as a patrolman, or equal or higher rank, and that the assignment to him of duties as City Manager were, and are, in addition to his duties as a local policeman. 3.
