R-137-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON APPROVING A GENERAL PLAN AMENDMENT TO <br />AMEND THE LAND USE DESIGNATION OF PROPERTY <br />LOCATED AT 801 NORTH RANCHO AVENUE IN THE CITY OF <br />COLTON FROM LIMITED COMMERCIAL TO GENERAL <br />COMMERCIAL: DAP NO. 000-335 <br />WHEREAS, Rancho Colton LLC filed an application (File No. DAP -000-335) <br />requesting an amendment to the Colton General Plan to amend the land use designation of <br />certain property located at 801 North Rancho Avenue (Assessor Parcel Nos. 0162-291-013, 15 & <br />17) ("Subject Site") in the City of Colton, County of San Bernardino from Limited Commercial to <br />General Commercial ("Application"); and <br />WHEREAS, the Application was referred to all affected public agencies pursuant <br />to section 65352 of the Government Code; <br />WHEREAS, the Application was reviewed, studied, and found to comply with the <br />California Environmental Quality Act ("CEQA") as more fully described below; <br />WHEREAS, on October 26, 2004, the Planning Commission of the City of Colton <br />("Planning Commission") conducted a duly noticed public hearing on the Application at which <br />time all persons wishing to testify in connection with the Application were heard and the <br />Application was fully studied; <br />WHEREAS, the Planning Commission adopted a Resolution recommending <br />approval of this Amendment to the General Plan of the City of Colton; <br />WHEREAS, on December 7, 2004, the City Council of the City of Colton ("City <br />Council") conducted a duly noticed public hearing on the Application at which time all persons <br />wishing to testify in connection with the Application were heard and the Application was fully <br />studied; and <br />occurred; <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. Based on the entire record before the City Council, all written and <br />oral evidence presented to the City Council, and the findings made in this Resolution, the City <br />Council of the City of Colton hereby amends the General Plan land use designation for the <br />Subject Site, as set forth on the attached Exhibit "Al", from "Limited Commercial" to "General <br />Commercial" ("General Plan Amendment"). <br />28 <br />RVPU]3\MXM\682850.1 <br />
