R-39-04 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, <br />PURSUANT TO GOVERNMENT CODE SECTION 21025, MAKING <br />DETERMINATION OF DISABILITY STATUS FOR LOCAL SAFETY EMPLOYEE <br />JAMES LAWRENCE BARTH <br />WHEREAS, THE City of Colton (hereinafter referred to as Agency) is a contracting <br />agency of the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a contracting <br />agency determine whether an employee of such agency is in employment in which he is <br />classified as a local safety member; is disabled for purposes of Public Employees' <br />Retirement Law; and, whether such disability is "industrial" within the meaning of such law: <br />and <br />WHEREAS, the City Council confirms that a Worker's Compensation Claim was filed <br />by James Lawrence Barth alleging disability from his position as Fire Engineer; and, <br />whether such disability is "industrial" within the meaning of such law; and, <br />WHEREAS, the City Council has reviewed the medical and other evidence relevant <br />to such alleged disability. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that James L. Barth was rendered <br />incapacitated within the meaning of the Public Employees' Retirement Law for performance <br />of his duties in the position of Fire Engineer, that the disability was the result of injuries to <br />lower back and right leg, under the provisions of Government Code Section 21156; and, <br />BE IT FURTHER RESOLVED that the City Council finds and determines that James <br />L. Barth was incapacitated within the meaning of the Public Employees' Retirement Law for <br />performance of his duties in the position of Fire Engineer. <br />Reso James Barth 042004 <br />Page 1 of 2 <br />
