Neither James L. <br />Barth nor the City of Colton has applied to the Worker's Compensation Appeals Board for a <br />determination pursuant to Section 21025 whether such disability is industrial: and, <br />BE IT FURTHER RESOLVED that the member is separated from his employment in <br />the position of Fire Engineer after expiration of his leave rights under Section 21025.4 of the <br />Government Code, wherein his last work day on paid status was September 1, 2003, and <br />that no dispute as to the expiration of such leave rights is pending; and, <br />BE IT FURTHER RESOLVED that the primary disabling condition precludes James <br />Lawrence Barth from performing the duties and responsibilities as Fire Engineer. <br />PASSED, APPROVED and ADOPTED this 20th day of April 2004. <br />ATTE <br />v <br />CAROLINA P.
