1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20i <br />21' <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />purposes of the community and park facilities and services are to promote the health and <br />welfare of residents; and <br />WHEREAS, the City Council has determined that the proposed non -subsidized fees <br />for non-residents are justified because: (1) the fees do not discriminate on the basis of <br />race, color, religion or national origin; (2) the fees are not higher than the City's cost to <br />provide and maintain the services and facilities; and (3) the fees are not disproportionately <br />higher than the fees charged to residents; and <br />WHEREAS, based on the information contained in this Resolution and all other <br />information presented to the City Council on this matter, the City Council desires to <br />establish new and updated fees under the police power granted to cities by Article XI, <br />Section 7 of the California Constitution and pursuant to the provisions of Government Code <br />section 66016. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />1. Notice of the public hearing at which this Resolution was considered <br />was properly given pursuant to the provisions of Government Code section 66016, in <br />which: (1) the City published notice of the public hearing twice at least 10 days before the <br />date of the hearing; (2) the City sent notice of the meeting at least 14 days in advance to <br />any interested person who had filed a written request; and (3) the City made available to <br />the public at least 10 days before the meeting the data indicating the amount of the <br />estimated costs required to provide the services for which the proposed fees will be levied <br />and the revenue sources anticipated to provide the services, including General Fund <br />revenues. <br />2. All oral and written presentations made to and heard by the City <br />Council during the public hearing for this Resolution were properly considered. <br />3. The cost estimates, including the data upon which the cost estimates <br />are based, which was produced by City staff and considered by the City Council in <br />establishing fees pursuant to this Resolution, are reasonable cost estimates for the <br />provision and maintenance of the City services and facilities to which the fees pertain and <br />were made available to the public pursuant to Government Code section 66016. <br />4. There is a reasonable relationship between the fees to be collected for <br />the provision of various City services and facilities and the City's costs in providing and <br />RVPUB\NGS\672123.1 <br />K, <br />
