R-66-04 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DENYING THE APPEAL AND UPHOLDING THE <br />PLANNING COMMISSION'S DECISION TO DENY A REQUEST <br />FOR PLACEMENT OF CHAIN LINK FENCING ON PROPERTY <br />LOCATED AT 1537 MACY AVENUE: FILE INDEX NO. DAP -000- <br />275 <br />WHEREAS, an application was filed by Alonza and Rhonda Scott ("Applicants") to <br />permit the continued placement of a chain link fence along the front and north side property lines of <br />property located at 1537 Macy Avenue in the City of Colton ("Subject Property'); and <br />WHEREAS, Section 18.58.030(A) and 18.38.050 of the Colton Municipal Code <br />provide that the Colton Design Review Committee ("DRC") is authorized to review, approve, <br />conditionally approve or deny applications for chain link fencing after giving consideration to <br />appearance, structural quality and durability; and <br />WHEREAS, the Application was referred to the Colton DRC and denied by the DRC <br />on April 5, 2004; and <br />WHEREAS, the Application was timely appealed to the Colton Planning Commission <br />("Planning Commission"); and <br />WHEREAS, on April 27, 2004, the Planning Commission considered the appeal of <br />the Application at which time all persons wishing to testify in connection with the proposed <br />Application were heard, and the appeal of the Application was comprehensively reviewed; and <br />WHEREAS, the Planning Commission denied the appeal of the Application because <br />they believed that a chain link fence on this property would erode the visual appearance and <br />aesthetics of the neighborhood; and <br />WHEREAS, subsequent to the Planning Commission's denial of the appeal of the <br />Application, the Applicants timely appealed the determination to the Colton City Council ("City <br />Council") <br />WHEREAS, on June 15, 2004 the City Council considered the appeal of the <br />Application; and <br />RVPUB\MXM\673834.1 <br />1 <br />
