R-103-05 <br />A RESOLUTION OF THE CITY COUNCIL OF THE OF THE CITY <br />OF COLTON UPHOLDING THE PLANNING COMMISSION'S <br />APPROVAL, IN PART, OF DAP -000-449, WHICH INCLUDES <br />DESIGN REVIEW, A CONDITIONAL USE PERMIT AND MAJOR <br />VARIANCE FOR A PROPOSED 63,796+ SQ. FT. RETAIL <br />SALES, STORAGE AND RESTAURANT BUILDING WITH <br />OVERHEIGHT FREEWAY ORIENTED SIGNS, ADDITIONAL <br />SIGNS, REDUCED PARKING AND AN OVERHEIGHT BUILDING <br />WITH A MAXIMUM HEIGHT OF 70 FT. ON PROPERTY <br />LOCATED AT 855 ASHLEY WAY <br />WHEREAS, Ashley Furniture Industries (the Applicant) filed applications (File No. <br />DAP -000-449) requesting approval of design review, a conditional use permit and major variance <br />for a proposed 63,796± square foot retail sales, storage and restaurant building with an <br />overheight freeway oriented sign, additional signs, reduced parking and an overheight building <br />("Application") on property located at 855 Ashley Way. ("Subject Site"); and <br />WHEREAS, the City of Colton Planning Commission (the "Planning Commission") <br />held a public hearing on the Application on July 12, 2005 after giving published notice of the <br />Application; and <br />WHEREAS, on July 12, 2005 the Planning Commission by a vote of 4 to 0 (3 <br />Commissioners absent) approved the Application with a condition limiting the height of the retail <br />sales building to a maximum of sixty feet (60'); and <br />WHEREAS, on July 18, 2005 a timely appeal of the Planning Commission's <br />determination was filed by the Applicant ("Appeal"); and <br />WHEREAS, the City of Colton City Council ("City Council") held a duly noticed <br />appeal hearing on the Application on August 16, 2005, after giving published notice of the <br />Appeal; and <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. General/Specific Plan Consistency. The City Council of the City of <br />Colton hereby determines that the proposed Application is consistent with the goals and policies <br />of the City of Colton General Plan and the Cooley Ranch Planned Community Plan.
