The construction of a retail <br />sales/storage building and restaurant is consistent with this designation. <br />SECTION 2. Design Review & Conditional Use Permit. The City Council of the <br />City of Colton hereby approves the Conditional Use Permit and Design Review elements of the <br />Application. The City of Colton finds that the proposed uses are in accord with the Colton <br />General Plan and the Cooley Ranch Planned Community Plan as well as the purposes of the <br />land use designation in which the Subject Site is located. In addition the proposed uses, <br />together with the conditions applicable thereto, including a condition limiting the height of the <br />retail building to a maximum of seventy feet (70') will not be detrimental to the public health, <br />safety or welfare, or materially injurious to properties or improvements in the vicinity. Finally, <br />with the approval of a major variance, the proposed uses will comply with each of the applicable <br />provisions of this Cooley Ranch Planned Community Plan and Colton Zoning Ordinance <br />SECTION 3. Manor Variance. The size and the topography of the Subject Site <br />provides special circumstances that allow the applicant's request for a Major Variance. The <br />project site is 3.7 acres that will accommodate an approximately 63,796 square foot retail <br />furniture facility. The Subject Site is also approximately 10 feet lower in grade than the Interstate <br />215 Freeway. Due to the size of the building, larger lettering is required in order to provide <br />sufficient exposure for the proposed business to the general public traveling along the 1-215 <br />Freeway. An increase in the height of the freeway oriented electronic message pylon sign from <br />45 feet to 55 feet is also warranted for the reasons set forth above. In addition larger lettering is <br />required on the building wall signs. Finally, an increase in the height of the portion of the building <br />(building tower) from 50 feet to 70 feet is justified for visibility purposes and to create an <br />architectural design element that is in scale with the rest of the development. <br />SECTION 4. The City Council hereby approves the Appeal and upholds the <br />Planning Commission's approval in part of the Application, with an increase in the height of the <br />retail building to 70 ft. subject to the conditions attached hereto. <br />SECTION 5. The City Council, in accordance with the California Environmental <br />Quality Act (CEQA) hereby finds that the proposed project is within the scope of the prior <br />Negative Declaration prepared for the Ashley Furniture site, which was adopted by the Planning <br />ORANGE\MXM\19380.1 - 2 - <br />
