R-120-05 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON TO ESTABLISH FEES FOR PREFERENTIAL PARKING <br />PERMITS <br />WHEREAS, under the police power granted by Article XI, Section 7 of the <br />California Constitution, cities may impose fees, charges and rates for certain municipal <br />services; and <br />WHEREAS, in addition to the authority granted by the State Constitution, <br />Government Code sections 66016 and 66018 provide that a city may establish or <br />increase fees for certain public services by resolution; and <br />WHEREAS, on August 2, 2005, the City Council approved Ordinance No. 0-12-05 <br />which established a preferential parking program within the City under Chapter 10.40 of <br />the Colton Municipal Code ("Code"); and <br />WHEREAS, Section 10.40.100 of the Code provides that the City Council may <br />establish, by resolution, fees to recover costs of administering the preferential parking <br />program; and <br />WHEREAS, the City Council has determined that the fees proposed in this <br />Resolution are reasonable, fair and equitable in nature and proportionately <br />representative of the costs incurred by the City for the preferential parking program; <br />WHEREAS, based on the information contained in this Resolution and all other <br />information presented to the City Council on this matter, the City Council desires to <br />establish preferential parking permit fees (the "Fees"), under the police power granted to <br />cities by Article XI, Section 7 of the California Constitution and pursuant to the provisions <br />of Government Code sections 66016 and 66018. <br />
