R-145-05 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON UPHOLDING THE PLANNING COMMISSION <br />DENIAL OF A MODIFICATION TO THE CONDITIONS OF <br />APPROVAL TO AN EXISTING CONDITIONAL USE <br />PERMIT TO PERMIT THE INSTALLATION OF A STORAGE <br />UNIT BEHIND AN EXISTING CHURCH FACILITY ON <br />PROPERTY GENERALLY LOCATED AT 754 HERBERTS <br />LANE: FILE INDEX NO. DAP -000-489 <br />WHEREAS, an application was filed by La Nueva Uncion ("Applicant") to <br />amend an approved conditional use permit for the purpose of installing a temporary metal <br />storage unit behind an existing church facility ("Application") on property generally located <br />at 754 Herberts Lane ("Subject Site"); and <br />WHEREAS, the Application was referred to all affected public agencies for <br />review and consideration; and <br />WHEREAS, the Application was reviewed, studied, and found to be <br />inconsistent with the City's adopted General Plan; and <br />WHEREAS, on September 27, 2005 the Planning Commission of the City of <br />Colton ("Planning Commission") conducted duly noticed public hearing on the Application <br />at which time all persons wishing to testify in connection with the proposed Application <br />were heard, and the Application was comprehensively reviewed; and <br />WHEREAS, on September 27, 2005 the Planning Commission by a vote of <br />5-0 denied the Application; and <br />WHEREAS, the applicant has appealed the denial of the Application within <br />the required timeframe; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />have occurred. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />28 <br />ORANGE\MXM\21657.1 - 1 - <br />
