ARTICLE I <br />EMPLOYER-EMPLOYEE RELATIONS <br />Section 1: Recognition <br />The City of Colton (hereinafter "the City") hereby recognizes the Communications Workers of America Local 9588 <br />(hereinafter "the Union") as the exclusive representative for the purpose of meet and confer with respect to wages, <br />hours, terms and conditions of employment for all employees within the classifications as set forth below: <br />Community Service Officer <br />Police Dispatcher I <br />Police Dispatcher H <br />Police Services Clerk I <br />Police Services Clerk II <br />Senior Police Dispatcher <br />Senior Police Services Clerk <br />Should any valid Federal or State law or final determination of any board or court of competent jurisdiction affect <br />any provisions so affected shall be made to conform to the law or determination and otherwise this Memorandum of <br />Understanding shall continue in full force and effect. <br />Nothing in the above shall be construed as requiring an employee to join the recognized union nor to maintain his or <br />her membership in the recognized union as a condition of employment. <br />Section 2: Grievance Procedure: <br />A. Statement Of Purpose <br />The purpose and objectives of the grievance procedure are to: <br />1. Assure fair and equitable treatment of all employees and to promote harmonious relations among <br />employees and their supervisors. <br />2. Afford employees a written and simple means of obtaining consideration of their grievance by informal <br />means at supervisory level and review of the supervisor's decisions. <br />3. Resolve grievances as quickly as possible and to correct, if possible, the causes of grievances, thereby <br />reducing the number of grievances and future similar complaints. <br />B. Definitions <br />1. Day - A work day unless otherwise stated. A work day is a day on which City Hall is open for business <br />for its full normal working hours. <br />2. Grievant - Any person employed full-time by the City, except those persons elected by popular vote. A <br />Union may file a grievance on behalf of itself or its members. <br />3. Grievance - An alleged violation or non-compliance with the provisions of this MOU, any <br />supplemental MOU, City of Colton's written or unwritten personnel rules and regulations, departmental <br />rules and regulations, and other policies and practices. The following disciplinary actions taken against <br />permanent employees are appealable under this procedure: <br />a. Suspensions in excess of 3 days <br />b. A salary reduction for which the financial equivalent exceeds 24 working hours <br />c. Demotions <br />d. Dismissals <br />Page 3 of 18 <br />CWA MOU expires 063007 <br />3/7/2005 <br />
