1 RESOLUTION NO. R-42-05 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA FOR PRELIMINARY APPROVAL OF THE ENGINEER'S 4 REPORT FOR THE COLTON LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT NO. 1 FOR FISCAL YEAR 5 2005/2006. 6 The City Council of the City of Colton, California (hereafter referred to as the "City Council") does resolve as follows: 7 8 WHEREAS, the City Council of the City of Colton, California, has, by previous 9 Resolutions, ordered the preparation of the Fiscal Year 2004/2005 Engineer's Report for the 10 District known and designated as the Colton Landscape and Lighting Maintenance 11 Assessment District No. 1 (hereafter referred to as the "District") pursuant to the provisions of 12 the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the Streets and Highways 13 Code of California, beginning with Section 22500 (hereafter referred to as the "Act"); and, 14 WHEREAS, there has not been presented to this City Council the Engineer's Report 15 as required by Chapter 1, Article 4, Section 22566 of said Act; and, 16 WHEREAS, this City Council has examined and reviewed the Engineer's Report as 17 presented, and is preliminarily satisfied with the District, each and all of the budget items and 18 19 documents as set forth therein, and is satisfied that the assessments, have been spread in 20 accordance with the special benefits received from the improvements, operations, 21 maintenance and services to be performed within each Benefit Zone of the District, as set for 22 in said Report. 23 NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL FOR THE DISTRICT, AS FOLLOWS: 24 Section 1: That the above recitals are all true and correct. 25 26 Section 2: That the Engineer's Report as presented, consists of the following: 27 A Description of Improvements (Plans & Specifications). 28 The Annual Budget (Costs and Expenses of Services, Operations and Maintenance) 1
