R-54-05 <br />2 <br />3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />ESTABLISHING A REDEMPTION FEE FOR THE RECOVERY OF COSTS <br />4 FOR RETRIEVAL AND STORAGE OF ABANDONED SHOPPING CARTS <br />AND LAUNDRY CARTS <br />5 <br />WHEREAS, under the police power granted by Article XI, Section 7 of the California <br />6 <br />Constitution, cities may impose fees, charges and rates for certain municipal services; and <br />7 <br />WHEREAS, in addition to the authority granted by the State Constitution, Government Code <br />8 <br />section 66016 provides that a city may establish or increase fees for certain public services by <br />9 <br />resolution; and <br />10 <br />WHEREAS, the City Council of the City of Colton has determined that in order to continue <br />11 <br />12 providing effective service for the public welfare, the City must establish and increase fees for <br />13 certain municipal services which accurately reflect the City's true costs in providing such services; <br />14 and <br />15 WHEREAS, State law specifically provides that the City may recover its costs incurred for <br />16 retrieving and storing abandoned shopping carts and laundry carts, pursuant to Business and <br />17 Professions Code section 22435.7; and <br />18 WHEREAS, Colton Municipal Code section 6.18.090 provides that the City Council may <br />19 establish by resolution a redemption fee to recover all costs of removal, storage and related <br />20 administrative procedures for the removal and storage of any abandoned cart within the City; and <br />21 WHEREAS, although the City has heretofore borne these costs and not charged a fee for <br />22 these services, the City Council has determined that it is no longer cost effective for the City to <br />23 continue to bear these costs; and <br />24 WHEREAS, the City Council has determined that in order to continue providing this service <br />25 which benefits the public welfare, it is in the best interest of the City to establish a redemption fee as <br />26 described above which accurately reflects the City's true costs for retrieving and storing abandoned <br />27 shopping carts and laundry carts; and <br />28 WHEREAS, the City Council has determined that the fee proposed in this Resolution are <br />reasonable, fair and equitable in nature and is proportionately representative of the costs incurred by <br />1 <br />
