I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17' 18 19 20 21 22 23 24 25 26 27 28 the City for the described services; and WHEREAS, based on the information contained in this Resolution and all other information presented to the City Council on this matter, the City Council desires to establish a redemption fee for the retrieval and storage of abandoned shopping carts and laundry carts, underthe police power granted to cities by Article XI, Section 7 of the California Constitution and pursuant to the provisions of Government Code section 66016. BE IT NOW THEREFORE RESOLVED AS FOLLOWS: 1. Notice of the public hearing at which this Resolution was considered was properly given pursuant to the provisions of Government Code section 66016, in which: (1) the City published notice of the public hearing twice at least 10 days before the date of the hearing; (2) the City sent notice of the meeting at least 14 days in advance to any interested person who had filed a written request; and (3) the City made available to the public at least 10 days before the meeting the data indicating the amount of the estimated costs required to provide the service for which the proposed redemption fee will be levied and the revenue sources anticipated to provide the service, including General Fund revenues. 2. All oral and written presentations made to and heard by the City Council during the public hearing for this Resolution were properly considered. 3. The cost estimates, including the data upon which the cost estimates are based, which was produced by City staff and considered by the City Council in establishing the redemption fee pursuant to this Resolution, are reasonable cost estimates for the provision of the City services to which the redemption fee pertains and were made available to the public pursuant to Government Code section 66016. 4. There is a reasonable relationship between the redemption fee to be collected for the provision of City services described in this Resolution and the City's costs in providing those services, as identified in the data made available to the public. 5. The redemption fee for the removal and storage of any abandoned cart within the City shall be $25 per cart. 6. The redemption fee amount does not exceed the actual or estimated reasonable costs to the City of providing the services to which the fee relates.
