1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />`m <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />increase the administrative fines and penalties for building and safety code violations to a <br />maximum fine of $1,000; and <br />WHEREAS, in light of the above noted statutory change to administrative fines and <br />penalties for building and safety code violations, the City desires to increase the administrative <br />fines and penalties for all violations of the Colton Municipal Code to provide greater incentives <br />for residents and businesses to comply with the Colton Municipal Code; and <br />WHEREAS, the City Council recognizes that it is especially important to provide <br />appropriate incentives for citizens to comply with the City's fireworks regulations, as contained in <br />Chapter 6.32 of the Colton Municipal Code, for the health and safety of Colton residents and the <br />protection of property, and <br />WHEREAS, Chapter 6.32 of the Colton Municipal Code establishes misdemeanor) <br />penalties up to $1,000 for violations of the City's fireworks regulations; and <br />WHEREAS, the City Council desires to specifically increase administrative fines and <br />penalties for fireworks violations to provide greater incentives for compliance; and <br />WHEREAS, the City Attorney has determined that State law does not place express <br />limits on the amount of administrative fines and penalties that may be imposed by cities for <br />violations that can otherwise be prosecuted as misdemeanors. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />1. As set forth in Chapter 8.12 of the Colton Municipal Code, that following a <br />reasonable warning period, the penalty for all misdemeanor violations of the Colton Municipal <br />Code and all building and safety violations of the Colton Municipal Code for issuance of a first <br />administrative citation shall be two hundred fifty dollars ($250). The penalty for a second <br />administrative citation issued within a twelve month period for the same violation shall be five <br />hundred dollars ($500). The penalty for a third and each subsequent administrative citation for <br />the same violation issued within a twelve month period shall be one thousand dollars ($1,000). <br />2. Notwithstanding the penalties and fines in effect for administrative citations <br />for any other violation of the Colton Municipal Code, the penalty for issuance of a first <br />-2- <br />
