ARTICLE L• EMPLOYER - EMPLOYEE RELATIONS <br />Section 1: Recognition <br />The City recognizes the Association as the recognized bargaining agent for the following <br />classifications: <br />Fire Battalion Chief <br />Fire Engineer <br />Firefighter <br />Firefighter Medic <br />Fire Captain <br />Fire Marshal <br />Section 2: Management Rights <br />It is understood and agreed that the City retains all of its powers and authority to direct, manage, and <br />control to the full extent of the law. Included in, but not limited, to those duties and powers are the <br />rights to: determine its organization; direct the work of its employees; determine the times and hours <br />of operation; determine the level, means, and kinds of services to be provided; establish its policies, <br />goals, and objectives; determine staffing patterns; determine the number and kinds of personnel <br />required; contract out work, transfer work out of the unit, maintain the efficiency of City operations, <br />build, move, or modify facilities; establish budget procedures and determine budgetary allocation; <br />determine the methods of raising revenue and take action on any matter in the event of an <br />emergency. Emergency is a sudden, generally unexpected, occurrence or occasion requiring <br />immediate action which affects City facilities or equipment or otherwise involves an Act of God or <br />specific governmental order requiring the City to take certain action or refrain from taking certain <br />action. In addition, the City retains the right to hire, classify, assign, evaluate, promote, discipline <br />and terminate employees. <br />Prior to implementing any decision to contract out, the City shall notify and negotiate, upon request, <br />the effect of such decision on the terms and conditions of employment of Unit members to the <br />extent such effects are negotiable. <br />Section 3: Association Rights <br />It is agreed that the Association shall have access to use of City facilities for the conduct of general <br />membership, Board and Committee meetings. The Association agrees that meetings shall not cause <br />undue disruption of City business by either frequency or duration. The Association shall notify the <br />Fire Chief or his designated representative prior to Association meetings utilizing City facilities. <br />Two members of the negotiating team shall be allowed reasonable time off with pay for all meetings <br />for meeting and conferring which shall be mutually set by the City and the Association.
