I RESOLUTION NO. R-124-06 <br />2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, <br />3 CALIFORNIA, CALLING UPON: (1) THE SAN BERNARDINO COUNTY <br />BOARD OF SUPERVISORS TO FINALIZE AND EXECUTE THE <br />4 TENTATIVE SETTLEMENT AGREEMENTS WITH THE CITIES OF <br />COLTON AND RIALTO, AND (2) THE REGIONAL WATER QUALITY <br />5 CONTROL BOARD, SANTA ANA REGION TO ASSIST THOSE CITIES TO <br />RECOVER CLEAN-UP COSTS FROM THE CORPORATE AND OTHER <br />6 ENTITIES RESPONSIBLE FOR POLLUTING THE RIALTO/COLTON <br />GROUNDWATER BASIN <br />7 <br />WHEREAS, the City of Colton is responsible for supplying a safe, affordable and <br />8 <br />reliable drinking water source to its residential and commercial customers; and <br />9 <br />WHEREAS, the City owns and possesses valuable water rights in the Rialto/Colton <br />10 <br />Groundwater Basin and relies on this aquifer to meet its needs for water; and <br />11 <br />WHEREAS, a clean groundwater supply is essential to the welfare and vitality of the <br />12 <br />City and the health and wellbeing of the public; and <br />13 <br />WHEREAS, perchlorate is a chemical principally used to accelerate the combustion <br />14 <br />of rocket fuels and propellants and in the manufacture of explosives, munitions, flares, ordnance, <br />15 <br />and pyrotechnic products, such as fireworks; and <br />16 <br />WHEREAS, perchlorate that is disposed of, discharged or released into the <br />17 <br />environment is a hazardous substance within the definitions of the Comprehensive Environmental <br />18 <br />Response, Compensation and Liability Act, as amended by the Superfund Amendment and <br />19 <br />Reauthorization Act of 1986 (42 U.S.C. 9601, et seq.); the Resource Conservation and Recovery <br />20 <br />Act of 1976 (42 U.S.C. 6901, et seq.); California Health and Safety Code section 25300, et seq.; and <br />21 <br />the Porter -Cologne Water Quality Control Act, California Water Code sections 13000, et seq.; and <br />22 <br />WHEREAS, the United States Environmental Protection Agency and the California <br />23 <br />Office of Environmental Health Hazard Assessment have found that perchlorate causes adverse <br />24 <br />human health effects, including inhibition of iodine uptake to the thyroid gland, producing physical <br />25 <br />and developmental problems, particularly in pregnant women and their developing fetuses and <br />26 <br />behavioral changes and mental retardation in children, and <br />27 <br />WHEREAS, from 1951 to the present various entities, including the United States, <br />28 <br />governmental contractors, and fireworks and explosives manufacturers have owned and operated <br />facilities on a 160 -acre parcel in the City of Rialto and conducted on that parcel a range of activities <br />1 <br />
