1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />that used perchlorate, including the manufacture of explosive cartridges, photoflash cartridges, <br />flares, ground burst simulators, pyrotechnics, and solid rocket propellant research and development, <br />and <br />WHEREAS, in addition to the actions of the responsible parties, the County of San <br />Bernardino ("County") has also allowed ongoing releases and disposal of significant amounts of <br />perchlorate from various locations and facilities within the County's Mid Valley Sanitary Landfill and <br />related land owned by the County; and <br />WHEREAS, perchlorate was initially detected in three (3) of the City of Colton's <br />drinking water supply wells, drawing water from the Rialto/Colton Groundwater Basin. Upon <br />detection of perchlorate, these wells were taken off-line and the City built treatment facilities to clean <br />up the perchlorate contamination; and <br />WHEREAS, the City of Colton has committed a substantial amount of money for the <br />treatment of the three (3) affected wells, investigation of the contamination in the Rialto/Colton <br />Groundwater Basin, and clean-up of the Basin; and <br />WHEREAS, in January 2003, the Regional Water Quality Control Board issued a <br />Clean-up and Abatement Order to the County and in September, 2004, the Board issued a Water <br />Replacement Order to the County. These Orders of the Board have effectively require the County to <br />install a line of wells north of the Rialto Airport area for the protection of the City of Rialto and its <br />citizens. However, notwithstanding implementation of substantial measures under those Orders, the <br />County has failed to compensate Rialto or Colton, or hold either City harmless from any other <br />expenses incurred by these cities because of the County's release of perchlorate; and <br />WHEREAS, the Cities of Colton and Rialto met with County Supervisor Gonzales and <br />Chairman Postmus in August 2005 with the result that County staff and City staff were instructed to <br />attempt to reach an agreement whereby the public agencies would settle and jointly pursue the <br />corporate and other entities responsible for contaminating the Rialto/Colton Groundwater Basin, with <br />the result that the polluters, and not the constituents and citizens of the County and the cities, would <br />pay for the ultimate clean-up and provide replacement water in the meantime; and <br />WHEREAS, the County and the Cities of Colton and Rialto participated in court- <br />ordered mediation, which resulted in the parties tentatively agreeing upon a settlement whereby the <br />E <br />
