R-161-06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DENYING THE APPEAL AND UPHOLDING THE <br />PLANNING COMMISSION'S DENIAL OF AN <br />APPLICATION FOR A CONDITIONAL USE PERMIT FOR <br />THE SALE OF HARD LIQUOR FOR OFF-SITE <br />CONSUMPTION AT AN EXISTING SERVICES <br />STATION/CONVENIENCE STORE, FOR FILE INDEX NO. <br />DAP -000-639, FOR PROPERTY LOCATED 420 NORTH <br />LA CADENA DRIVE <br />WHEREAS, Shri Ranchhod Corporation ("Applicant") filed an application <br />(File No. DAP -000-639) requesting approval of a Conditional Use Permit ("CUP") for fuel <br />sales and hard liquor sales for off-site consumption, design review, and demolition <br />permit for the remodel of an existing service station/convenience store, and new 1,728 <br />square foot canopy ("Application or the "Project") located at 420 North La Cadena Drive, <br />Assessor Parcel No. 162-101-14, in the City of Colton, County of San Bernardino <br />("Subject Site"); and <br />WHEREAS, the Application was referred to all affected public agencies for <br />I review and consideration; and <br />WHEREAS, on November 14, 2006 the Planning Commission of the City of <br />Colton ("Planning Commission") conducted a duly noticed public hearing on the <br />Application at which time all persons wishing to testify in connection with the Application <br />were heard, and the Application was comprehensively reviewed; and <br />WHEREAS, at its meeting on November 14, 2006, the Planning <br />Commission approved the Project, with the exception of the CUP for the sale of hard <br />liquor for off-site consumption ("Hard Liquor CUP"); and <br />RVPUB\HSHANE\724903.1 <br />
