1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, in order to approve the Application, the Planning Commission is required to find that the Application is consistent with the City of Colton ("City") General Plan, and the City's Zoning Ordinance (Title 18 of the City's Municipal Code), and that the Application will not be detrimental to the health, safety and welfare of the residential neighborhood adjacent to the proposed Project; and WHEREAS, the Planning Commission denied the Hard Liquor CUP, finding that hard liquor sales for off-site consumption on the Subject Site could be detrimental to the public health, safety and welfare, and is not in conformance with the General Plan of the City; and WHEREAS, the convenience store portion of the Project is already licensed by the California Department of Alcoholic Beverage Control (ABC) for beer and wine sales for off-site consumption; and WHEREAS, a Stater Brothers Market, a liquor store located across the street from Stater Brothers on Valley Boulevard, and the 5 Way Liquor Market located at North La Cadena Drive and Bordwell Avenue all currently provide hard liquor sales for off-site consumption in the vicinity of the Subject Site-, and WHEREAS, with the exception of one existing service station/convenience store located at the southwest corner of Pennsylvania Avenue and Mill Street, no other service stations provide hard liquor sales within the City; and WHEREAS, the Planning Commission found that due to the existence of a number of establishments offering hard liquor sales for off-site consumption within the vicinity of the Subject Site, granting the Hard Liquor CUP would lead to an excessive number of establishments selling hard liquor for off-site consumption within the vicinity of RVPUB\HSHANE\724903.1 -2-
