1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, in order to approve the Application, the Planning Commission <br />is required to find that the Application is consistent with the City of Colton ("City") <br />General Plan, and the City's Zoning Ordinance (Title 18 of the City's Municipal Code), <br />and that the Application will not be detrimental to the health, safety and welfare of the <br />residential neighborhood adjacent to the proposed Project; and <br />WHEREAS, the Planning Commission denied the Hard Liquor CUP, finding <br />that hard liquor sales for off-site consumption on the Subject Site could be detrimental to <br />the public health, safety and welfare, and is not in conformance with the General Plan of <br />the City; and <br />WHEREAS, the convenience store portion of the Project is already <br />licensed by the California Department of Alcoholic Beverage Control (ABC) for beer and <br />wine sales for off-site consumption; and <br />WHEREAS, a Stater Brothers Market, a liquor store located across the <br />street from Stater Brothers on Valley Boulevard, and the 5 Way Liquor Market located at <br />North La Cadena Drive and Bordwell Avenue all currently provide hard liquor sales for <br />off-site consumption in the vicinity of the Subject Site-, and <br />WHEREAS, with the exception of one existing service station/convenience <br />store located at the southwest corner of Pennsylvania Avenue and Mill Street, no other <br />service stations provide hard liquor sales within the City; and <br />WHEREAS, the Planning Commission found that due to the existence of a <br />number of establishments offering hard liquor sales for off-site consumption within the <br />vicinity of the Subject Site, granting the Hard Liquor CUP would lead to an excessive <br />number of establishments selling hard liquor for off-site consumption within the vicinity of <br />RVPUB\HSHANE\724903.1 <br />-2- <br />
