Based on the entire record before the City Council and all <br />written and oral evidence presented, and the findings made in this Resolution, the City <br />Council hereby finds that the Hard Liquor CUP application does not comply with the <br />zoning regulations set forth in Title 18 of the City of Colton Municipal Code (the "Zoning <br />Code"). <br />A. Section 18.58.060(H)(2) of the Zoning Code provides that in <br />order to grant a CUP, the City Council must find that: The proposed use, together with <br />the conditions applicable thereto will not be detrimental to the public health, safety or <br />welfare, or materially injurious to properties or improvements in the vicinity. <br />1. Granting the Hard Liquor CUP could lead to negative effects to the <br />public health, safety and welfare. <br />a. Advertising associated with hard liquor sales could have a negative <br />aesthetic effect in the area of the Subject Site, which is located in close proximity to an <br />entrance to the City, and a historic district within the City. <br />b. In light of the number of existing establishments offering hard liquor <br />sales for off-site consumption within the vicinity of the Subject Site, granting the Hard <br />Liquor CUP for the Project would lead to an over -saturation of establishments selling <br />hard liquor for off-site consumption within the vicinity of the Subject Site, which could be <br />detrimental to the public safety and welfare, and lead to effects such as a congregation <br />RVPUffiHSHANE\724903.1 <br />-5 - <br />
