R-45-06 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, TO SUMMARILY VACATE A PORTION OF <br />STEEL ROAD, BETWEEN 1-215 AND 1-10 FREEWAYS, PURSUANT <br />TO CALIFORNIA STREETS AND HIGHWAYS CODE SECTION' <br />8330 ET SEQ. <br />WHEREAS, the City of Colton ("City") holds a right-of-way for street and <br />public utility purposes over, under and upon a portion of Steel Road, located west of the I- <br />215 freeway, south of the 1-10 freeway, measuring approximately 399 long and 48 feet <br />wide, which terminates at the parcel of land owned by Transition Properties LP, which area <br />is more fully described and depicted in Exhibit "A" attached hereto and incorporated herein <br />by reference (hereinafter, "Portion of Steel Road"); and <br />WHEREAS, the City has received a request to summarily vacate the Portion of Steel <br />Road from a property owner, Transition Properties LP, which owns all three (3) parcels <br />accessing the Portion of Steel Road, and <br />WHEREAS, the California Streets and Highways Code provides that a street or <br />highway may be summarily vacated if certain conditions are met; and <br />WHEREAS, the Portion of Steel Road meets the statutory conditions for summary <br />vacation, which include the following facts: (A) The Portion of Steel Road has been <br />impassable to vehicular and pedestrian travel for the past five (5) years; (B) No public <br />money has been spent on improvements to the Portion of Steel Road for the past five (5) <br />years; and (C) No in-place public utility facilities will be affected by this summary vacation; <br />and <br />WHEREAS, the City shall reserve and except from the vacation all easements and <br />rights regarding public utilities and future streets or highways, pursuant to California Streets <br />and Highways Code section 8340; and <br />1 <br />
