I WHEREAS, this summary vacation of the Portion of Steel Road is made pursuant to 2 the requirements of California Streets and Highways Code, Division 9, Part 3 (Sections 3 8300 et seq.), Chapter 4. — Summary Vacation ; and 4 WHEREAS, all other legal prerequisites to the adoption of this Resolution have 5 occurred. 6 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: 7 8 1. Incorporation of Recitals. The City Council hereby finds and 9 determines that the recitals of this Resolution are true and correct and are hereby 10 incorporated into this Resolution. 11 2. Order of Vacation. The City Council, under the authority vested in it by 12 the California Streets and Highways Code, hereby orders the vacation of the Portion of 13 Steel Road, located west of the 1-215 freeway, south of the 1-10 freeway, measuring 14 approximately 399 feet long and 48 feet wide, which terminates at the parcel owned by 15 Transition Properties LP. 16 3. Reservations and Exceptions. Pursuant to California Streets and 17 Highways Code section 8340, the City Council reserves and excepts from the summary 18 vacation: (1) all easements and rights regarding construction, maintenance, operation, 19 replacement, removal and or renewal of any public utilities; (2) any easement for a future 20 street or highway; (3) all easements and rights regarding in-place public utility facilities; and 21 (4) all easements and rights for vehicular and non -vehicular trails for use by the public over 22 the area to be vacated, including granting such easements or rights to another state or 23 local public agency. 24 4. Certification, Recordation and Retention. The City Clerk shall cause a 25 certified copy of this Resolution, attested by the City Clerk under seal, to be recorded 26 without acknowledgment, certificate of acknowledgment, or further proof, in the office of the 27 San Bernardino County Recorder. Pursuant to California Streets and Highways Code 28 section 8336, no fee shall be charged for such recordation. The City Clerk shall permanently maintain a true and correct copy of this Resolution. 2
