I WHEREAS, this summary vacation of the Portion of Steel Road is made pursuant to <br />2 the requirements of California Streets and Highways Code, Division 9, Part 3 (Sections <br />3 8300 et seq.), Chapter 4. — Summary Vacation ; and <br />4 WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />5 occurred. <br />6 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />7 <br />8 1. Incorporation of Recitals. The City Council hereby finds and <br />9 determines that the recitals of this Resolution are true and correct and are hereby <br />10 incorporated into this Resolution. <br />11 2. Order of Vacation. The City Council, under the authority vested in it by <br />12 the California Streets and Highways Code, hereby orders the vacation of the Portion of <br />13 Steel Road, located west of the 1-215 freeway, south of the 1-10 freeway, measuring <br />14 approximately 399 feet long and 48 feet wide, which terminates at the parcel owned by <br />15 Transition Properties LP. <br />16 3. Reservations and Exceptions. Pursuant to California Streets and <br />17 Highways Code section 8340, the City Council reserves and excepts from the summary <br />18 vacation: (1) all easements and rights regarding construction, maintenance, operation, <br />19 replacement, removal and or renewal of any public utilities; (2) any easement for a future <br />20 street or highway; (3) all easements and rights regarding in-place public utility facilities; and <br />21 (4) all easements and rights for vehicular and non -vehicular trails for use by the public over <br />22 the area to be vacated, including granting such easements or rights to another state or <br />23 local public agency. <br />24 4. Certification, Recordation and Retention. The City Clerk shall cause a <br />25 certified copy of this Resolution, attested by the City Clerk under seal, to be recorded <br />26 without acknowledgment, certificate of acknowledgment, or further proof, in the office of the <br />27 San Bernardino County Recorder. Pursuant to California Streets and Highways Code <br />28 section 8336, no fee shall be charged for such recordation. The City Clerk shall <br />permanently maintain a true and correct copy of this Resolution. <br />2 <br />
