1 <br />2 WHEREAS, the Application was reviewed and studied by the Planning <br />3 Commission and, pursuant to State CEQA Guidelines section 15300.2(c), the Planning <br />4 Commission found, based on substantial evidence in the record, that because there is a <br />5 reasonable possibility that the Application will have a significant effect on the <br />6 environment due to unusual circumstances, staff's proposed use of an exemption under <br />7 CEQA is inappropriate and more extensive environmental review is necessary. Thus <br />8 the Planning Commission found the Application to be out of compliance with the CEQA; <br />9 and <br />10 <br />11 WHEREAS, at the May 9, 2006 Planning Commission meeting, the <br />12 Commission adopted Resolution No. R-03-06 denying the Application, without <br />13 prejudice, in order for staff to complete an environmental analysis of the Application, <br />14 including the preparation of an Initial Study; and <br />15 <br />16 WHEREAS, a timely appeal of the denial of the Application was received <br />17 by the City Clerk ("Appeal"); and <br />18 <br />19 WHEREAS, on July 18, 2006, the City Council of the City of Colton ("City <br />20 Council") conducted a duly noticed public hearing on the Appeal of the Application at <br />21 which time all persons wishing to.testify in connection with the proposed Appeal and the <br />22 Application were heard, and the Appeal and Application were comprehensively <br />23 reviewed and considered; and <br />24 <br />25 WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />26 have occurred. <br />27 <br />2811 BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />
