I SECTION 1. Based on the entire record before the City Council, all written <br />2 and oral evidence presented, and the findings made in this Resolution, the City Council <br />3 hereby finds that because an additional unpermitted structure, which was not addressed <br />4 in the Application, exists on the Subject Site further modification to the existing <br />5 Conditional Use Permit is required, including a comprehensive project description. <br />6 <br />7 SECTION 2. Based on substantial evidence in the entire record before the <br />8 City Council, including all written and oral evidence presented, and the findings made in <br />9 this Resolution, the City Council hereby finds that Application does not comply with <br />10 CEQA because environmental review has not been completed and an Initial Study is <br />I I required because there is a reasonable possibility that the Application will have a <br />12 significant effect on the environment due to unusual circumstances (State CEQA <br />13 Guidelines section 15300.2(c).) Among other things, the Initial Study should consider: <br />14 <br />15 A. Consistency of the Application with the General Plan, As part of <br />16 the Initial Study, staff is directed to consider consistency of the Application with the <br />17 General Plan including the following: <br />18 <br />19 1 . Principle C-1 of the Land Use Element provides that: <br />20 Industrial uses need to be located in areas compatible with surrounding uses such as <br />21 adjacent to railroads and freeways. The closest homes are located approximately 350 <br />22 ft. west of the Subject Site. Applicant's operations currently occur on the eastern half of <br />23 the Subject Site, which is approximately 1,000 ft. from the closest neighborhood. <br />24 <br />25 During the public testimony presented to the Planning <br />26 Commission, a resident from the neighborhood located near <br />27 the Subject Site stated that prior to paving the Subject Site, <br />28 Applicant had operated smelters and wrecked vehicles on <br />the dirt. This resident expressed concern about lead and <br />4 <br />
