1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15' <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City prepared the Final Revised EIR and, pursuant to <br />Public Resources Code section 21092.5, the City provided copies of the responses to all <br />commenting agencies; and <br />WHEREAS, the Planning Commission reviewed and considered the <br />information contained in the Revised DEIR and Final Revised EIR and made its <br />recommendation for approval of the Project in regular session held June 13, 2006; and <br />WHEREAS, an appeal of the Planning Commission recommendation for <br />approval of the Project was made to the City Council by Colton Iron & Metal ("CIM"), and <br />consideration of that appeal was placed on the City Council agenda of July 18, 2006; <br />and <br />WHEREAS, after full consideration of the appeal by CIM, the City Council <br />hereby rejects that appeal; and <br />WHEREAS, as contained herein, the City has endeavored in good faith to <br />set forth the basis for its decision on the Project; and <br />WHEREAS, the City satisfied all the requirements of CEQA, the State <br />CEQA Guidelines, and the Court's Statement of Decision in the preparation of the <br />Revised DEIR and Final Revised EIR, which is sufficiently detailed so that all of the <br />potentially significant environmental effects of the Project, as well as feasible mitigation <br />measures, have been adequately evaluated; and <br />SACRAM ENTO\JBUCKMAN\33667.5 <br />� <br />
