1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />2� <br />29 <br />2� <br />� <br />2E <br />2� <br />2� <br />additional environmental review under Public Resources Code sections 21166 and <br />21092.1 and State CEQA Guidelines section 15088.5; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution <br />have occurred; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />RESOLVES AS FOLLOWS: <br />I� <br />FINDINGS <br />At a regular session assembled on July 18, 2006, the City Council determined <br />that, based on all of the evidence presented, including, but not limited to, the Revised <br />Final and Revised Draft EIR, written and oral testimony given at Planning Commission <br />and City Council meetings and hearings, and submission of testimony from the public, <br />organizations and regulatory agencies, that there are no environmental impacts <br />associated with the Project that are significant and cannot be substantially lessened <br />through the implementation of mitigation measures and that the following environmental <br />impacts associated with the Project are either: (1) less than significant and do not <br />require mitigation; or (2) potentially significant, and each of these impacts will be <br />avoided or substantially lessened through implementation of the identified mitigation <br />measures. <br />This document contains the findings required underthe California Environmental <br />Quality Act ("CEQA") (Pub. Resources Code, §§ 21000 et seq.) and the State CEQA <br />Guidelines (Cal. Code Regs., tit. 14, §§ 15000 et seq.) supporting the adoption of the <br />Revised Final Environmental Impact Report ("Revised FEIR") for the proposed Pacific <br />Rail Metal Shredding Operation ("Project"). The Revised FEIR addresses, and is limited <br />to, the traffic, hazardous materials and air quality issues identified by the San <br />Bernardino Superior Court as inadequately evaluated in the Project's 2004 <br />Environmental Impact Report ("2004 EIR"). <br />A. SUMMARY OF PROJECT HISTORY <br />Pacific Rail Industries ("applicant" or "Project proponent") is currently operating a <br />railcar dismantling and salvage operation under a Conditional Use Permit ("CUP") from <br />the City.
