Finally, the City Council finds that with respect to the remaining goals, <br />policies and objectives of the General Plan, the proposed Project will not directly conflict <br />with any goals, policies and objectives that are fundamental, mandatory and <br />unambiguous. <br />SECTION 3. Based on the entire record before the City Council and all written <br />and oral evidence presented, including the Planning Commission staff report and attachments <br />thereto, the findings made in this Resolution and by the Planning Commission in Resolution No. <br />R-05-06, the 2004 Record, the 2004 EIR (including the addenda), the Revised DEIR and the <br />Revised Final EIR and the comments and responses thereto, the City Council finds that the <br />proposed use complies with each of the applicable provisions of Title 18 of the Colton Municipal <br />Code. Except for the proposed overheight wall on the southerly property line, the Project <br />complies or will comply, with adherence to mitigation measures, with all requirements of the <br />Colton Zoning Ordinance (Title 18). (See August 24, 2004, Planning Commission Agenda <br />Report at pp. 2-5; and June 13, 2006, Planning Commission Agenda Report.) <br />A. The Applications propose a use that is not specifically permitted in the M-2 <br />heavy industrial zone, but that may be approved following review by the Planning Commission. <br />(Colton Municipal Code § 18.28.010.) <br />B. The Planning Commission found (see PC Resolution No. R-05-06) that the <br />Applications are for a use that supports the intent of the M-2 zone, which is intended to provide <br />for the establishment of industrial uses essential to the development. The City Council concurs <br />with this finding. <br />C. The Planning Commission also found (see PC Resolution No. R-05-06) <br />that the Applications are compatible with other uses permitted in the M-2 zone, and that the <br />emission of odor, dust, fumes, gas, noise, vibration and other similar undesirable characteristics <br />will not be detrimental to any abutting zone or the community as a whole. The City Council also <br />concurs with this finding. <br />The Project includes design features that mitigate the impact of the <br />Applications. For example, the construction of a fluff containment <br />structure, use of enclosed steel tank for water storage, and paving <br />of the property will reduce dust, and other undesirable <br />characteristics of the Project. (See Reivsed DEIR page 3-5, <br />Testimony of Chuck Siroonian, November 16, 2004 public hearing) <br />SECTION 4. Based on the entire record before the City Council and all written <br />and oral evidence presented, including the Planning Commission staff report and attachments <br />thereto, the findings made in this Resolution and by the Planning Commission in Resolution No. <br />R-05-06, the 2004 Record, the 2004 EIR (including the addenda), the Revised DEIR and the <br />Revised Final EIR and the comments and responses thereto, the City Council finds that the <br />proposed amendment together with the conditions applicable thereto, will not be detrimental to <br />the public health, safety or welfare, or materially injurious to properties or improvements in the <br />vicinity of the Subject Site. The proposed amendment authorizes: (1) the installation and <br />operation of a metal shredder as an expansion to an existing scrap metal facility; (2) the <br />construction of an approximate 30' X 250" metal building; and (3) an increase in the volume of <br />railroad transloading.
