1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, the City and Agency desire that the Funding and Construction <br />Management Agreement be amended to extend the schedule of the Washington Street <br />Median and Landscaping to June 30, 2008, in order to expand the scope of this project to <br />add additional landscaping along the Washington St. corridor; and <br />WHEREAS, the City and the Agency desire that the Funding and Construction <br />Management Agreement be amended to redirect funds from authorized projects, which were <br />completed using other funding sources, and remaining funds from completed projects be <br />combined to complete authorized infrastructure projects within the project area, as <br />recommended by the City Engineer. The redirected funds are being requested to <br />compensate for overages of the Dauer Park Improvements project and expand the scope of <br />the Washington St. Median Improvements; and <br />WHEREAS, the City and the Agency further desire to authorize its City <br />Manager and Executive Director, respectively to make additional amendments, should they <br />be required, to extend time limits and reallocate funds between the projects as already <br />approved by the City Council and Redevelopment Agency; and <br />WHEREAS, the City and the Agency desire to amend the Funding and <br />Construction Management Agreement to effectuate the foregoing. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON, <br />CALIFORNIA, DOES DETERMINE, RESOLVE AND ORDER AS FOLLOWS: <br />Section 1. The recitals set forth above are true and correct. <br />Section 2. The City Council hereby approves Amendment No. 3 to the <br />Funding and Construction Management Agreement on file with the City Clerk. <br />Section 3. Except as amended by Amendment No. 3, the Funding and <br />Construction Management Agreement is in all respects confirmed and all of the terms, <br />provisions and conditions thereof shall be and remain in full force and effect. <br />E <br />
