R-57-07 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA TO <br />VACATE A PORTION OF THE ALLEYWAY LOCATED WEST OF 11TH STREET, EAST OF <br />COLTON AVENUE, BETWEEN `F' STREET AND `G' STREET, PURSUANT TO <br />CALIFORNIA STREETS AND HIGHWAYS CODE SECTION 8330 ET SEQ. <br />WHEREAS, the California Streets and Highways Code provides that a street or <br />highway, including an alley or alleyway, may be summarily vacated if certain conditions are <br />met; and <br />WHEREAS, the City has received a request from property owner Ms. Fred Wirz to <br />summarily vacate a portion of the alleyway located west of 11th Street, east of Colton Avenue, <br />between 'F' Street and 'G' Street, which was created by the recordation of the Map of the <br />Town of Colton in 1887; and <br />WHEREAS, the specific portion of the alleyway described herein has been <br />impassable to vehicular and pedestrian travel for the past five (5) years due to lack of access <br />(dead-end). <br />WHEREAS, no public improvements have been made to, or public money spent on, <br />the portion of the alleyway described herein for the past five (5) years.; and <br />WHEREAS, this summary vacation is made pursuant to the California Streets and <br />Highways Code, Division 9, Part 3 (sections 8300 et seq.), Chapter 4 — Summary Vacation. <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE AS FOLLOWS: <br />SECTION 1. Incorporation of Recitals. The City Council hereby finds and determines <br />that the recitals of this Resolution are true and correct and are hereby incorporated into this <br />Resolution. <br />SECTION 2. Order of Vacation. The City Council, under the authority vested in it by <br />the California Streets and Highways Code, hereby orders the vacation of the portion of the <br />alleyway located west of 11th Street, east of Colton Avenue, between 'F' Street and 'G' Street. <br />SECTION 3. Public Utility Easements. The City owns certain public utility easements <br />within the portion of the alleyway to be vacated and the property owner Ms. Fred Wir <br />understands that she may not build upon or otherwise encumber the City's easements within <br />the portion of the alleyway to be vacated. <br />1 <br />
