City of Colton <br />Annexation of Tract 16249 to <br />Benefit Zone 2, Landscape and Lighting Maintenance Assessment District No. 2 <br />Notice of Public Hearing and Ballot Procedures <br />NOTICE IS HEREBY GIVEN that on December 20, 2005, the City Council (the "City Council") of the City <br />of Colton adopted Resolution No. R-164-05 (the "Resolution of Intention") declaring its intention, pursuant <br />to the provisions of Division 15 of the Streets and Highways Code of the State of California, commonly <br />known as the Landscaping and Lighting Act of 1972, to order the annexation of Tract 16249 to Benefit Zone <br />2, Landscape and Lighting Maintenance Assessment District No. 2, City of Colton, County of San <br />Bernardino, State of California (the "Annexation") for the annual maintenance of certain public landscaping <br />improvements and appurtenant facilities; and that also on said date, a report prepared by the Engineer of <br />Work was filed with and preliminarily approved by the City Council. The Report contains, among other <br />things, the plans and specifications for the public improvements to be maintained and serviced, an estimate <br />of the annual cost of the maintenance and servicing of said public improvements and incidental costs and <br />expenses in connection therewith, a diagram of the Annexation and the boundaries and dimensions of the <br />separate parcels of land therein, and an assessment roll setting forth the amount of the annual assessment to <br />be levied on each parcel of land in the Annexation. <br />DESCRIPTION OF IMPROVEMENTS <br />In general, the public landscaping improvements encompasses the irrigation systems, landscaping, and <br />appurtenant facilities within Tract Map 16249 and are further identified on said Tract Map as follows: <br />Lot A <br />Lot B <br />• Maintenance of detention basin to include removal of debris and weed <br />abatement. <br />• Maintenance of landscaping and irrigation system. <br />Parkways and medians, extending within the 80 -foot right-of-way, extending along Reche <br />Canyon Road <br />s Maintenance of landscaping and irrigation system. <br />COST OF ANNUAL MAINTENANCE AND SERVICING <br />The total estimated annual cost of energy and maintenance of the facilities, including incidental costs, is <br />$18,102.05, including an up -to 3% annual increase in the assessments if the current assessments do not meet <br />the corresponding year's expenses and Council action supports the increase. <br />The method of assessment is based on Equivalent Benefit Units (EBU), with a residential dwelling equal to <br />one EBU. There are 47 EBU within the proposed Annexation for an annual cost of $385.15 per EBU, <br />including an up -to 3% annual increase in the assessments if the current assessments do not meet the <br />corresponding year's expenses and Council action supports the increase. <br />Page 1 of 2 <br />
