Notice of Public Hearing and Ballot Procedures <br />(Continued) <br />PUBLIC HEARING <br />A public hearing will be held at 6:00 pm, February 21, 2006 at a meeting of the City Council in the City <br />Council Chambers of the City of Colton, 650 North La Candena Drive, Colton, CA for the purpose of <br />hearing protests to the proposed Annexation. Pursuant to Section 54153 of the California Government Code, <br />the following procedure will be followed by the City Council to determine whether a "majority protest' <br />exists at the close of the public hearing. <br />An "Official Property Owner Assessment Ballot' (the "Assessment Ballot') has been enclosed with this <br />notice. The property owned by you, according to the last equalized assessment roll for taxes of the County of <br />San Bernardino or more recent information available to the City of Colton, is described on said Assessment <br />Ballot. At this time, all amounts set forth herein and the assessments are based on estimates only and annual <br />assessments will be based on actual annual expenses. The estimated annual assessment to be levied on your <br />property, for the annual maintenance of the improvements, is shown on the Assessment Ballot. <br />NOTE: The enclosed Official Property Owner Assessment Ballot is THE Official Assessment Ballot! It is <br />not a sample ballot. In order to make this Assessment Ballot count in determining whether a "majority <br />protest' exists, you must mark it ("Yes" or "No"), date it, sign it, and submit it to the City Clerk of the City <br />of Colton no later than the close of the public hearing. If for any reason the City Clerk has not received your <br />Assessment Ballot prior to the close of the public hearing it will not be considered. <br />After the Assessment Ballot has been marked "Yes" or "No", dated and signed, it may be returned to the City <br />Clerk of the City of Colton in the enclosed, self-addressed stamped return envelope. The owner of any <br />parcel may use this Assessment Ballot in order to express either support for or opposition to the proposed <br />Annexation. The Assessment Ballot can be submitted either by mail as described above or by personal <br />delivery, either prior to or at the close of the public hearing. Please see the Assessment Ballot for further <br />instructions regarding the mailing or personal delivery of the Assessment Ballot. <br />Immediately following the close of the public hearing, whether on February 21, 2006 or on such later date as <br />the hearing may be continued to, the returned Assessment Ballots will be tabulated. The tabulation will be <br />made for both in support of and in opposition to the assessment with the ballots being weighted in <br />accordance with the number of benefit units included in the proposed Annexation. <br />In the event that Assessment Ballots in opposition exceed those in support, there will be a "majority protest', <br />and the City Council will be precluded from proceeding with the proposed Annexation. In the event that <br />Assessment Ballots in support exceed those in opposition, the City Council will proceed with the proposed <br />Annexation. <br />The City Council has designated, Maritza Tapia, Administrative Analyst, Public Works Department of the <br />City of Colton (909) 514-4211 as the person to answer inquiries regarding Landscape and Lighting <br />Maintenance Assessment District No. 2 and the proposed Annexation thereto. <br />Page 2 of 2 <br />
