I <br />• <br />DEPARTMENT OF CONSERVATION DIVISION <br />OF RECYCLING <br />CITY OF COLTON <br />CONTRACT NUMBER: 5( <br />-88 -LC -09 <br />1. <br />ARTICLES <br />EVALUATION: The Contractor is hereby <br />advised that its <br />performance under this contract will <br />be evaluated, and <br />submitted to the Director of the Department <br />of Conservation <br />within 30 days after the termination <br />of this 'contract. <br />2-. <br />COMM€TNICATIONS. All official communication <br />from the <br />Contractor to the State shall be directed <br />to the Contract <br />Manager as designated by the. Chief at: <br />Division of Recycling, <br />Department of.Conservation, 1025 P Street, <br />Sacramento, CA. <br />95814. <br />3. <br />MODIFICATIONS - CHANGES: The budget <br />of the awarded contract <br />may be revised up to twenty percent <br />(20%) from one budget <br />item to another without increasing the <br />total amount of the <br />contract. These changes can be <br />made without formal <br />amendment, when made in writing and <br />agreed to by both <br />parties. <br />By written change order, the Contract <br />Manager may at any time <br />during the effective period of the <br />contract order changes <br />within the Agreement without invalidating <br />this contract, so <br />long,as.such changes do not increase <br />the amount due under the <br />contract, extend the term of the Agreement <br />or result in <br />substantial change in the Scope of Work. <br />The latter changes <br />;hall require a formal contract amendment. <br />4. <br />WRITTEN APPROVAL OF PROJECTCHANGES" <br />The Contractor must <br />' <br />obtain prior written approval from <br />the Contract Manager <br />before making changes to.the contract. <br />All requests should <br />include a description of the proposed <br />change and the reasons <br />for the change. Such changes should <br />include any budget line <br />item revisions, minor task modifca tions, <br />management staff <br />adjustments, and changes in contractor/subcontractor <br />or the <br />scope of work. <br />5. <br />SUBCONTRACTORS: The Contractor steal <br />' be entitled to make use <br />of, its own staff and such subcontractors) <br />"as are mutually <br />acceptable to the Contractornd <br />the State. All <br />subcontractor(s) specifically identified <br />in the Scope of Work <br />are considered to be acceptable to the <br />State. Any 'change in <br />subcontractors which have been it <br />} e found <br />acceptable b <br />to be accepta Y <br />the State, shall be subject to either <br />a contract amendment or <br />written change order, All contracts <br />between, the {contractor <br />and Subcontractors shall be subject <br />to approval of the <br />Contract Manager. <br />The Contractor is responsible for <br />controlling costs and <br />maintaining accurate record- of 'nvo'ices <br />received from <br />s•ubcontractor(s). <br />I <br />
