DEPARTMENT OF CONSERVATION DIVISION OF RECYCLING <br />CITY OF COL ON <br />CONTRACT NUMBER: 50-88-LC-09 <br />6 SUBCONTRACTOR WORK: It is understood and agreed that the <br />Contractor and each, subcontractor shall comprise the <br />1. contractor team. The Contractor shall function as the <br />Prime Contractor (hereafter referred to as Contractor) of <br />this project and shad manage the performance of the <br />technical/expert subcontractors All references to the <br />°'Contractor" herein refer to the Prime, Contractor unless <br />otherwise noted <br />The Contractor, its.subcontractors and their employees shall <br />be responsible in the performance ofithe Contractor's work <br />under this contract in exercising the degree of skill and <br />care required by customarily accepted good professional <br />practices and procedures Any cost for failure to meet the <br />foregoing standards, or otherwise defective services, which <br />causes redundancy shall be borne by the Contractor and not <br />the Department <br />The Contractor shall be responsible for scheduling and <br />assigning subcontractors to specific tasks, coordinating <br />subcontractor accessibility to the Department staff, and <br />submitting completed products to the Contract Manager. <br />7. COMPETITIVE BIT REQUIREMENTS: In the event a subcontractor <br />is changed or added to those identified as subcontractors in <br />the Contractors response to the RFP, the Contractor shall <br />purchase thole services on a competitive bid basis. The Con- <br />tractor shall purchase services from the lowest responsible <br />bidder or pay the difference between the low bid and the one <br />:selected: All payment requests shall document the com- <br />petitive selection by including copies of at least three bids <br />for services subject to this condition. This condition may <br />be waived upon Contractor certification that, due to the <br />unique nature of the service, a sole source purchase is <br />justified. <br />8: ACCOUNTING RECORDS: The Contractor shall maintain financial <br />records, in accordance with generally accepted accounting <br />Principles, of expenditures incurred during the course of the <br />project including matching funds that may be required. Such <br />records shall be readily available for inspection by the <br />State. <br />E <br />Subcontra-ctor(s) employed by the.Contractor and .paid with <br />monies under the terms of this Agreement, shall be <br />responsible for maintaining accounting records as specified <br />in the above paragraph. <br />r <br />
