INTERIM FINANCING AGREEMENT FOR THE <br />COLTON/SAN BERNARDINO REGIONAL TERTIARY TREATMENT <br />AND WATER RECLAMATION SYSTEM (DEMONSTRATION PROJECT) <br />(City of Colton) <br />THIS AGREEMENT is made this 18th day of July , <br />1989, by and between the SANTA ANA WATERSHED PROJECT AUTHORITY, a <br />joint powers public agency ("SAWPA") on the one hand, and the CITY <br />OF COLTON ("COLTON") on the other hand. SAWPA and COLTON are <br />sometimes collectively referred to herein as the "PARTIES". <br />RECITALS <br />A. Each of the PARTIES is authorized and empowered to <br />contract with the other for the joint exercise of powers under <br />Articles I and II, Chapter 5, Division 7, Title 1 (commencing with <br />Section 6500) of the California Government Code, and each has the <br />authority to operate and maintain demonstration -scale and full-scale <br />wastewater treatment and water reclamation systems. <br />B. COLTON and the CITY OF SAN BERNARDINO ("SAN BERNARDINO"), <br />with the assistance of SAWPA, has examined the feasibility of <br />jointly constructing and operating a regional system that will <br />provide tertiary treatment of wastewater produced by COLTON's <br />wastewater treatment plant and SAN BERNARDINO's wastewater <br />treatment plant for disposal in the Santa Ana River. By means of <br />that certain written agreement by and between COLTON and SAN <br />BERNARDINO dated �'T_i�S , 1989, which agreement is <br />entitled "COORDINATED OPERATING AGREEMENT", COLTON and SAN <br />
