BERNARDINO have agreed to jointly pay all of the costs of leasing, <br />operating and maintaining a demonstration -scale REGIONAL TERTIARY <br />TREATMENT AND WATER RECLAMATION SYSTEM to treat and dispose of <br />wastewater produced within the respective service areas of SAN <br />BERNARDINO and COLTON. <br />C. By means of that certain written agreement dated <br />At-t.G+usr ► , 1989, which agreement is entitled "OPERATIONS AND <br />MAINTENANCE AGREEMENT", COLTON and SAN BERNARDINO have delegated the <br />responsibilities of constructing and operating the demonstration - <br />scale regional system to SAWPA. However, in order to construct the <br />demonstration -scale regional system, the PARTIES acknowledge and <br />agree that up to $760,000.00 is estimated to be necessary to plan <br />and design the facilities, and for land and right-of-way acquisition <br />purposes (hereinafter collectively referred as the "Initial Costs") <br />until such time as permanent financing is obtained. <br />D. In order to pay these Initial Costs, COLTON agrees to pay <br />SAWPA up to $190,000.00 to plan and design the demonstration -scale <br />facilities, and to acquire leases or purchase options for land and <br />rights of way. It is the purpose of this Interim Financing <br />Agreement to set forth the terms and conditions by which the funds <br />will be provided by COLTON to pay its share of the Initial Costs. <br />N <br />
