Hutton, Director of Public Works vw" <br />SUBJECT: Approval of Joint Cooperation Agreement.with the Date: September 12, 1989 <br />City of Loma Linda for Detention Basins in Tract <br />#12204, First Family Homes Reche Canyon Area and <br />Accept the Detention Basin Easements <br />As a condition of approval for Tract #12204, a solution was required to mittigate <br />upstream drainage from the proposed development. A drainage study was prepared by <br />C P Lange and Associates which indicates the'need to install a retention basin <br />upstream from the project reducing offsite drainage. <br />Tract #12204 is located on Prado Lane within the Reche Canyon area and bounds the <br />corporate limits of both Colton and Loma Linda. As part of the drainage study <br />submitted for review, it was recommended that detention basins be installed outstream <br />from the development thus reducing downstream drainage. The eastern and upstream <br />boundary of the Tract is in the corporate limit line between Colton and Loma Linda <br />(see attached Exhibit "A"). The proposal to construct detention basins upstream and <br />offsite of the project area was analyzed by the City Engineer and determined to be <br />the acceptable engineering method to resolve the collection of drainage and safe <br />outletting of drainage. <br />In addition, the City of Loma Linda reviewed the proposal and has agreed to allow <br />the construction of the offsite basins within its jurisdiction by the approval of a <br />joint cooperative agreement. The joint cooperative agreement outlines the location <br />of the basins, the points of collection and outletting, the authority allowing the <br />City of Colton to supervise and inspect the construction of the basins and a hold <br />harmless clause by and between both Cities. Additionally, the City of Loma Linda <br />has agreed to condition substantial landscaping and the annexation of the property <br />into the City of Colton's Landscape Maintenance District for perpetual maintenance <br />at such time the property develops in Loma Linda's jurisdiction (see attached letter <br />from the City of Loma Linda). <br />RECONMENDATION: <br />In order for the development to occur within Tract #12204, and to <br />condition to mittigate the upstream drainage, the construction of <br />occur. The City of Loma Linda is requesting a joint cooperation <br />the construction of said basins within its jurisdication.
