Assessment Committee. <br />Within ten days from the date the application was deemed <br />complete, the City must notify the OPA that the Application <br />has been accepted as complete. The OPA then has 60 days to <br />convene a meeting of the City as lead agency. all responsible <br />agencies. the Local Assessment Committee. the applicant and <br />the public to identify the issues which concern the agencies <br />and the public. <br />State law requires the creation of an appeal process whereby <br />local land use decisions can be overturned. This appeal <br />process reflects a recognition by the State that in limited <br />instances, the statewide interest in ensuring adequate capac- <br />ity for managing hazardous wastes will be sufficient to <br />override the substantial interest in maintaining local con- <br />trol over land use. <br />IV.A. GENERAL REQUIREMENTS FOR HANDLING AND STORAGE OF <br />HAZARDOUS MATERIALS <br />State and Federal governments have established programs which <br />require businesses that handle hazardous substances to pre- <br />pare an inventory of the hazardous substances stored and to <br />provide that list to a local agency designated to administer <br />the program. The Deoartment of Environmental Health Services <br />(DEHS) has been designated the administering agency for the <br />County of San Bernardino, including the incorocrated cities. <br />Funaing for this program is obtained from permit fees levied <br />against the hazardous material handlers. <br />With increased efforts to minimize and/or recycle wastes. <br />some hazardous waste aonerators may incorporate new proce- <br />dures into their manufacturing process to significantly <br />reduce their waste. The equipment for these technologies can <br />malfunction causing the potential +"Or a hazarcous substance <br />release. The CHWMP shall amend the Unitorm Environmental <br />Coae to require all râ–ºazardous waste generators and hazardous <br />material hand ers to report any such equipment malfunction or <br />upset i,riich may cause hazardous waste to be generated. <br />B. Underground Storage Requirements <br />Leaking underground storage tanks have caused ground -water - <br />contamination and Qther environmental concerns because of the <br />hazardous materials contained in tnem. The CHWMP shall do <br />the following: A) amend the underground storage tank ordi- <br />nance to maintain its consistency with State and Federal <br />requirements: B) continue to enforce the Uniform Environmen- <br />tal Health Code; C) maintain records of tank performance by <br />reviewing ongoing monitoring programs; 0) prepare an annual <br />report detailinq the number of tanKs under permit with the <br />County. <br />5 <br />
