additional evidence, complete workpapers and court <br />presentation material that will enable the Police Department <br />to prevail in the seizure and forfeiture of those assets. <br />(iii) Provider will initiate and complete financial investigation <br />accounting, upon request by authorized Police Department <br />personnel, for both administrative and judicial cases which <br />will not be investigated by the Police Department <br />investigators. The Police Department will from time to time <br />provide to Provider a list of such authorized personnel. <br />2) Confidentiality. Provider shall exercise due care in keeping all <br />information gathered during any financial investigation in <br />confidence, only releasing said information as authorized by <br />appropriate personnel of the Police Department or as directed by a <br />court of proper jurisdiction. <br />3) Fees. City authorizes the Pol* partment to pay Provider from <br />the Asset Forfeiture Account for services that fall <br />within federal asset forfeiture sharing program or from the Asset <br />Forfeiture Account # 62-230 for services that fall within the <br />State Asset Forfeiture Program as described in the following <br />payment schedule: <br />M Full Service Financial Investigation Accounting services <br />described in Paragraph I above shall be a flat 18% contingent <br />fee. The fee is to be calculated on the value of assets <br />deposited into either Asset Forfeiture Account # 42-14745-4or <br />Asset Forfeiture Account ;�� from such services. The <br />contingent fee shall be paid only on assets not previously <br />seized and forfeited in the applicable case. The value of <br />assets deposited into Ass = eiture Account # 42-14745-4or <br />Asset Forfeiture Account as the direct result of <br />Provider's assistance in any seizure and forfeiture of assets <br />from Full Service Financial Investigation Accounting shall be <br />utilized for calculating the contingent fee. Contingent fees <br />for seizure and forfeiture of personal property and/or real <br />property shall be based upon the profit from sale, and paid to <br />Provider within 30 days from the deposit of said funds into <br />Asset Forfeiture Account #7� for federal seizure cases <br />or Asset Forfeiture Account #42-14745-4 for state seizure <br />cases. <br />Property forfeited as the direct result of Provider's Full <br />Service Financial Investigation Accounting and which is not <br />liquidated by the Police Department within 90 days of the date <br />of forfeiture will have the fair market value at the date of <br />its forfeiture for purposes of establishing the contingent <br />fee. The contingent fee in such case will be payable to <br />Provider within 90 days from the date of forfeiture. Said <br />contingen shall be paid to Provider from Asset Forfeiture <br /># from assets seized under the federal <br />Account'=, <br />program, or rom Asset Forfeiture Account #42-14745-4 for <br />assets seized under the state program. <br />E0510 - 2 - <br />
