ENCROACHMENT PERMIT <br />GENERAL PROVISIONS <br />1. AUTHORITY: The Department of Public Works, City of Colton, <br />is the agency in charge of all engineering and public works <br />matters for the City. (Colton Civic Center, 650 North La Cadena <br />Drive, Colton, CA 92324, Telephone 714/370-5065). <br />II. NOTIFICATIONS: Permittee shall notify the Inspection Section of <br />The Department of Community Services: (1) Date work is to start. <br />(2) Date work has been completed. <br />III. COMPLIANCE WITH STATE CONSTRUCTIONS SAFETY ORDERS: Permitee and/ <br />or its contractor where applicable shall obtain a permit from <br />Division of Industrtial Safety, State of California, prior to <br />trench excavation if the excavation is over five (5) feet in depth <br />or workmen will be endangered by moving ground. <br />IV. SURVEY MONUMENTS: Section 8771 of the Business and Professions <br />Code makes the perpetuation of Survey Monuments the responsibility <br />of anyone performing construction work. When street intersections <br />are to be excavated or known survey monuments are to be destroyed <br />permittee shall notify the Engineering Division of the Department <br />of Community Services at least two weeks prior to construction . <br />V. PROTECTION OF TRAVELING PUBLIC: Permitee shall take adequate pre- <br />cautions for the protection of the traveling public at all times. <br />Barricades, flashing amber lights and warning signs together with <br />flagmen, where necessary, shall be placed and maintained in <br />accordance with the current Department of Public Works, State of <br />California, publication entitled Manual of Warning Signs, Lights <br />and Devices until the excavation is refilled, the obstruction <br />removed, and the roadway is made safe for the use of the traveling <br />public. <br />VI. ROAD CLOSURE: No road closure will be permitted without the prior <br />consent of the Department of Community Services. Permittee shall <br />also notify the City Fire and Police Department. Allow two weeks <br />to process request for overnight closure. <br />VII. ROAD RESTORATION: If permittee fails or refuses to refill any <br />excavation which he has made, or replace any pavement he has removed <br />or damaged, or remove any obstruction which he has placed in any <br />City roadway, the City of Colton may take corrective action as <br />necessary to protect the roadway and traveling public and the <br />permittee shall reimburse the City for any costs thereof. <br />VIII. PAYMENT OF COSTS: Permittee is liable for and shall pay upon <br />demand all City of Colton costs related to the permit, including <br />but not restricted to the costs of repairing or restoring the <br />City streets to the same or equal condition that they were in <br />before being cut or damaged as a result or permittee's activities. <br />
